HomeMy WebLinkAboutMINUTES - 04031990 - 1.82 THE BOARD OF COMMISSIONERS, HOUSING AUTHORITY OF THE COUNTY OF CONTRA COSTA RESOLUTION NO. 3581 ADOPTING REVISED PROCEDURE, GOVERNING PROCUREMENT POLICY WHEREAS, HUD Information Bulletin 90-33 dated March 7, 1990, implements provisions of 24 CFR Part 85.36 pertaining to procurement protests; and, WHEREAS, 24 CFR Part 85.36(12) requires that all grantees and subgrantees will have protest procedures to handle and resolve disputes relating to their procurements; and, WHEREAS, the Department of Housing and Urban Development has determined that each housing authority must adopt procurement protest procedures which confirm to applicable Federal law and the standards identified in the regulation; NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of the Housing Authority of the County of contra Costa hereby adopts the revised Procurement Procedure, Section 3.1, incorporating the required procurement protest procedure. Said revision is to become effective March 31, 1990 subject to HUD review and approval . RECOMMENDED ACTION: APPROVE proposed revised Procurement Policy and ADOPT Resolution No. 3581 approving proposed revised procurement procedures based on new standards issued in the Federal Register, 24 CFR Part 85.36, as recommended by the Advisory Housing Commission. II. FINANCIAL IMPACT: None. III. REASONS FOR RECOMMENDATION/BACKGROUND: New procurement standards were issued in the Federal Register, 24 CFR 85.36, and forwarded to the Housing Authority by HUD. Housing Authorities must establish their own procurement policies and procedures, which implement the requirements of §85.36. The revised Procurement Policy for the Housing Authority of the County, of Contra Costa includes these changes: Increasing the limit for purchase orders and contracts to $25,000 in Section A and Section B; and, adding Section F to comply with the standards established in 24 CFR 85.36. Additionally, HUD has now determined that all Housing Authorities must also include procurement protests by bidders in its procurement policies. In keeping with that decision, the Housing Authority proposes revising its Procurement Policy to include Procurement Protests, which confirm to applicable Federal law and the standards identified in the regulation. At its Regular Meeting on February 26, 1990 the Advisory Housing Commission voted to recommend adoption of the revised Procurement Policy, and at its Regular Meeting on March 19, 1990 the Advisory Housing Commission voted to recommend adoption of Resolution No. 3581 approving revised procurement procedures as mandated by HUD. IV. CONSEQUENCES OF NEGATIVE ACTION: Should the Board of Commissioners elect to not approve the proposed revised Procurement Policy and adopt Resolution No. 3581 approving the proposed revised procurement procedures, as mandated by HUD, the Housing Authority would not be in compliance with HUD regulations.
