RECOMUMATION
Adopt a position in SUPPORT of AB 4193 by Assemblyman Sher which
would authorize the Integrated Waste Management Board to levy a
full disposal cost fee on retailers or distributors of any type
of disposable goods in an amount equivalent to the true full cost
of disposal for the type of disposable goods for which the fee is
established. The bill would appropriate the funds thus collected
to establish programs for waste reduction, recycling and reuse
for the particular type of material from which disposable goods
have been made.
BACKGROUND:
The Board of Supervisors has been supportive of the imposition of
a deposit on materials which can be recycled or reused in order
to reduce their disposal to landfills. Assemblyman Sher has now
introduced AB 4193 which would authorize the Integrated Waste
Management Board to calculate the true full cost of disposing of
items to a landfill and impose a fee on retailers or distributors
of any type of disposable goods (other than beverage containers
already covered by the Beverage Container Recycling and Litter
Reduction Act) .
The bill defines "disposable goods" as any product in disposable
packaging, including food in plastic layered or waxed containers,
goods distributed in cellophane, goods packed in polystyrene and
other plastics, goods packaged in metal containers, goods
contained in plastic six pack or other similar multipack holders,

and goods in tin cans or glass containers. "Disposable goods"
also includes disposable one-time or one-way use products,
including plastic bags, disposable medical supplies, clay-based
paper advertising supplements and magazines, office paper,
newspapers, disposable diapers and paper or polystyrene plastic
plates or cups.
The funds which are collected from the imposition of this fee
would be allocated to establish programs for waste reduction,
recycling and reuse for the particular type of material from
which the disposable goods have been made.
Effective January 1, 1993 and annually thereafter the Integrated
Waste Management Board would be requested to report to the
Legislature on each fee imposed indicating the effectiveness of
disposal cost fees in providing economic incentives to reduce,
reuse and recycle goods which would otherwise be disposed of.
In view of the fact that AB 4193 would authorize the imposition
of fees on disposable goods, thereby providing a source of funds
to establish programs that emphasize reuse and recycling of such
goods and providing an economic incentive to reduce the use of
such materials it appears to be consistent with the Board of
Supervisors interests in this regard. It is therefore
recommended that the Board of Supervisors indicate its support
for AB 4193 .
