SUBJECT: East Bay Rail Plan
The Board received the recommendation of the Transportation
(Supervisors Schroder and Torlakson) authorizing Board members,
with the assistance of D. J. Smith Associated, to seek amendments
to AB 1145 (sher) to include $750 ,000 to study the East Bay Rail
Plan using funds from the petroleum Violation Escrow Account
(PVEA) . A copy of the report is attached and included as a part of
this document.
Judy Matzkin, representing the Organization to Save Our
Community (OSOC) , 1575 St. Helena Drive, Danville, requested the
Board to reaffirm an earlier position which stated that the
Southern Pacific Right of Way shall be used as a non-motorized
transportation route and underground utility corridor from Rudgear
Road south to the Alameda county line.
Supervisor Schroder advised that it was his intention to add
language to that effect.
Therefore, on recommendation of Supervisor Schroder, IT IS BY
THE BOARD ORDERED that the recommendation of the Transportation
Committee as set forth above and as amended to include specific
directions to D. J. Smith Associates to advise Byron Sher on how
the County would plan to use this money to study the East Bay Rail
Plan with the primary objective to improve air quality.
IT IS FURTHER ORDERED that Caltrans be REQUESTED as part of
the East Bay Rail Plan Study to include a study for a fixed guide-
way project within I-680 .

SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION•
Authorize Board members, with the assistance of D.J. Smith Associates,
to seek amendments to AB 1145 (Sher) to include $750, 000 to study the
East Bay Rail Plan using funds from the Petroleum Violation Escrow
Account (PVEA) .
REASONS FOR RECOMMENDATIONS/BACKGROUND:
On April 3 , 1990, the Board of Supervisors requested the Transportation
Committee to consider an amendment to AB 1145 to include $750, 000 to
study the East Bay Rail Plan, and to ask MTC to consider the .East Bay
Rail Plan in the programming of rail bond funds for the 1990 Regional
Transportation Improvement Program.
AB 1145 was introduced last year by Assembly Member Byron Sher of
Mountain View, to allocate $5, 620, 000 in Petroleum Violation Escrow
Account (PVEA) funds to the State Energy Commission for specified
transportation-related expenses in Alameda, San Mateo, and Santa Clara
counties. The bill passed the Assembly and is scheduled for its first
Senate hearing by the Committee on Energy and Public Utilities on April
19 . The January 24 , 1990 version .of AB 1145 is attached as Exhibit A.
The Transportation Committee considers the East Bay Rail Plan to have
significant potential to reduce auto emissions and energy consumption
for the Bay Area, and is an appropriate use of PVEA funds.
MTC's criteria for programming rail bond revenues in the 1990 RTIP
include consistency with its New Rail Starts Program. The
Transportation Committee recommends that the County advocate inclusion
of the East Bay Rail Plan in the New Rail Starts Program as a first
step, which will allow programming of rail bond revenues in subsequent
RTIPs. Members of the Transportation Committee and Supervisor Powers
are not available to testify at the New Rail Starts hearing on April
27. The Transportation Committee recommends staff submit testimony at
this hearing as previously authorized in the April 3 Board Order.

An act relating to transportation, and making an
appropriation therefor.
LEGISLATIVE COUNSEL'S DIGEST
AB 1145, as amended, Sher. Transportation: petroleum
violation escrow funds: appropriation.
(1) Under existing law, funds in the Petroleum Violation
Escrow Account, as defined in federal law, have been
disbursed to this state by the federal government and
deposited in the Federal Trust Fund.
This bill would, to the extent permitted by federal law,
appropriate $4,570,000 $5,620,000 of those funds, to be
disbursed by the Controller on approval of the Director of
Finance, to the State Energy Resources Conservation and
Development Commission for allocation for specified
transportation-related purposes.
(2) Existing law establishes the Katz Safe Schoolbus Clean
Fuel Efficiency Demonstration Program, and declares the

Legislature's intent to appropriate for implementation of that
program 1/2 of each future disbursement of federal oil
overcharge funds received by the state.
This bill would require that money in the Federal Trust
Fund received by the state from federal oil overcharge funds
which is available for appropriation during the 1989-90 fiscal
year be appropriated in accordance with the Legislature's
declared intent.
Vote: majority. Appropriation: yes. Fiscal committee: yes.

The people of the State of California do enact as follows:
1 SECTION 1. Notwithstanding Sections 13340 and
2 16361 of the Government Code and to the extent

6 of the money in the Federal Trust Fund, created by
7 Section 16360 of the Government Code, received by the
8 state from federal oil overcharge funds in the Petroleum
9 Violation Escrow Account, as defined by Section 155 of
10 the Further Continuing Appropriations Act of 1983 (P.L.
11 97-377) or other federal law, and received by the state
12 from federal oil overcharge funds available pursuant to
13 court judgments or federal agency orders, is hereby
14 appropriated to the State Energy Resources
15 Conservation and Development Commission for
16 allocation as follows:
17 (a) Three hundred thousand dollars ($300,000) to the
18 County of Santa Clara for the establishment and
19 operation of one or more transportation management
20 associations within the county.
21 (b) One million dollars ($1,000,000) to the County of
22 Santa Clara for improvements to intersections where
23 traffic signalization projects have been undertaken as
24 follows:

17 (4) Martin Luther King, Jr. Way and 34th Street,

23 Transportation projects funded under this section shall
24 comply with generally accepted engineering and public
25 safety criteria applicable to the projects.
26 SEC. 2. Money in the Federal Trust Fund created by
27 Section 16360 of the Government Code, received by the
28 state from federal oil overcharge funds in the petroleum
29 violation escrow account, which is available for
30 appropriation during the 1989-90 fiscal year, shall be
31 appropriated in accordance with subdivision (b) of
32 Section 4 of Chapter 1426 of the Statutes of 1988, which
33 declared the intent of the Legislature to appropriate
34 one-half of each future disbursement received by the
35 state from the account for implementation of the Katz
36 Safe Schoolbus Clean Fuel Efficiency Demonstration
37 Program (Part 10.7 (commencing with Section 17910) of
38 the Education Code) .
39 SEC. 3. Funds appropriated by this act from the
40 Petroleum Violation Escrow Account shall be disbursed
