Adopt a position in SUPPORT of AB 2666 by Assemblywoman Hansen
which would permit a city, county or fire protection district to
adopt more stringent requirements than are reflected in the
Uniform Building Code and Uniform Fire Code relating to fire and
panic safety as are found to be reasonably necessary because of
local climatic, geological or topographical conditions.
BACKGROUND:
The State Fire Marshal is charged under current law with adopting
fire and life safety standards for residential occupancies,
including single family dwellings. This is done through the
State Building Standards Commission. These adopted standards are
considered to be minimum fire and life safety requirements.
Many, if not most, communities within the State make amendments
to these standards to address needs or concerns within their own
city, county or fire district. These maybe in the form of
fire-safe roofing materials, built-in fire extinguishing systems,
fire alarm systems and similar fire protection features.
The Attorney General has issued an opinion indicating that local
governments do not have the right to modify the State Building
Standards on these matters.
AB 2666 has been introduced by Assemblywoman Hansen. As amended
April 4, 1990 , AB 2666 would clarify that cities, counties and

fire districts do indeed have the authority to adopt more
stringent standards relating to fire and panic safety which are
found to be necessary because of local climatic, geologic or
topographical conditions.
The bill provides that any fire district which proposes to adopt
an ordinance providing for such modifications shall, not less
than 30 days prior to noticing a proposed ordinance for public
hearing, provide a copy of the ordinance to each city or county
to which the ordinance would apply. The bill also provides for
an appeal process from the adoption of such an ordinance by a
fire district to the city council or county board of supervisors.
The bill also provides that it is not intended to invalidate any
ordinance or regulation in effect January 1, 1990 which mandates
the installation of residential fire sprinkler systems within
newly constructed dwellings units or in new additions to existing
dwelling units.
The bill also provides that no State Fire Marshal or local
standards relating to fire and panic safety shall apply to
manufactured homes except for the following:
1. That the area between the lower extremity of the
manufactured home and the ground be enclosed.
2. That the exterior of the manufactured home be covered with a
fire retardant material in the wildlands area of the state.
3. That vegetation around the manufactured home be removed
pursuant to existing law.
The bill also provides that it is not intended to authorize the
State Fire Marshal or local jurisdictions to adopt standards
mandating the installation of residential fire sprinkler systems
in dwelling units including, but not limited to manufactured
homes.
Chief William Maxfield of the Consolidated Fire District supports
AB 2666 and recommends that the Board of Supervisors also support
AB 2666 . In addition, the Board of Supervisors received a letter
from Assemblywoman Hansen requesting support for AB 2666. It is
therefore recommended that the Board of Supervisors indicate its
support for AB 2666, as amended April 4 , 1990.
