SPECIFIC REQUESTS)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECONM ENDATION
Indicate that the Board of Supervisors continues to SUPPORT SB
2400 by Senator Marks which would prohibit the manufacture,
distribution or sale on and after specified dates of various
polystyrene products made with specified chlorofluorocarbons
(CFCs) .
BACKGROUND
On April 17, 1990 the Board of Supervisors voted to support SB
2400 by Senator Milton Marks, as amended March 22 , 1990. On
April 2, 1990 SB 2400 was amended.
As amended April 2, 1990, SB 2400 would do all of the following:
1. Prohibit, on or after January 1 , 1991, the manufacture,
distribution or sale of any polystyrene foam food service
product or food packaging manufactured with CFC-11 or CFC-12
or any fully halogenated CFC.
2. Prohibit, on or after December 31, 1991, the manufacture,
distribution or sale of any rigid polystyrene foam product
manufactured with CFC-11, CFC-12 or any fully halogenated
CFC if chemical substitutes are commercially available and
have been approved by the necessary regulatory agencies.
3 . Prohibit, on or after January 1, 1994, the manufacture,

distribution or sale of any nonrigid polystyrene foam
product manufactured with CFC-11, CFC-12 or any fully
halogenated CFC, if chemical substitutes are commercially
available and have been approved by the necessary regulatory
agencies.
4. Require, beginning January 1, 1991, that manufacturers of
the products described above reduce by 25% each year the
emission of CFC-11, CFC-12 or any fully halogenated CFC.
5. Require, if by February 1, 1993 , it appears that the January
1, 1994 deadline cannot be met, the manufacturers,
distributors or sellers to report to the appropriate policy
committees of the Legislature by not later than July 1, 1993
explaining why they cannot comply.
The April 2, 1990 amendments place the "if chemical substitutes"
condition on the January 1, 1994 date in item #3 above and delays .
the reporting dates to the Legislature in item #5 above in regard
to the January 1, 1994 date, rather than the December 31, 1991
date.
To the extent that SB 2400 would tend to assist in controlling
the emission of CFCs into the environment it appears that it is
consistent with the Board' s concerns in the area of the
environment. It would, therefore, be appropriate for the Board
of Supervisors to indicate its continued support for SB 2400.
