LEGISLATION: AB 1430 (Eastin) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECONIlWIENDATION Adopt a position in SUPPORT of AB 1430 by Assemblywoman Eastin which would create the Hazardous Materials Use Reduction Institute at the Richmond Field Station of the University of California at Berkeley and would require the institute to conduct research, carry out specified training and information programs and by January 1, 1992 establish and provide for a hazardous materials use reduction postgraduate education and research program. BACKGROUND: Assemblywoman Eastin has introduced AB 1430 which, as amended January 25, 1990, would establish a Hazardous Materials Use Reduction Institute at the Richmond Field Station of the University of California at Berkeley. "Hazardous materials use reduction" is defined as in-plant changes in production processes or raw materials that reduce, avoid, or eliminate the use of hazardous materials, or the generation of hazardous by-products per unit of product, so as to reduce risks to the health of workers, consumers, or the environment, or parts of the environment. PHIL BATCHELOR,CLERK OF THE BOARD OF SUPERVISORS AND COUNTY ADMINISTRATOR M382 (10/88) BY �`��`'-`��'�� DEPUTY l The bill specifies that hazardous materials use reduction does not include promoting or requiring incineration, the transfer from one medium of release or discharge to other media, offsite hazardous waste recycling or any method of treating hazardous waste at the end of the production process. The bill establishes a Hazardous Materials Use Reduction Institute at the Richmond Field Station of the University of California at Berkeley. The Institute is directed to do all of the following: * Provide general information about and actively publicize the advantages of and developments in hazardous materials use reduction. * Establish courses, seminars, updates, guidelines and other publications, and other means of providing technical information for hazardous materials users, including small quantity users. * Develop and provide undergraduate curriculum and training for students and faculty on hazardous material use reduction. * By January 1, 1992 establish and provide for a hazardous materials use reduction postgraduate education and research program for individuals who seek degrees in this field of specialization. * Provide onsite technical extension services to help identify opportunities for hazardous materials use reduction among hazardous materials user groups and handlers. * Sponsor pilot projects to develop and demonstrate innovative technologies for hazardous materials use reduction. * Provide hazardous materials use reduction training and assistance to government employees, citizens, community groups, workers, labor representatives and local government boards and officials. * Establish an intensive technology transfer, research and technical assistance program regarding the most hazardous materials. * Study the social, environmental and economic costs and benefits of hazardous materials technologies as compared to hazardous materials use reduction practices. * Establish a competitive grant program for research on hazardous materials use reduction techniques and materials. * Conduct research on alternative methods of reducing the use of hazardous materials, including the reduction of hazardous materials in product formulation so as to reduce household, as well as industrial, hazards. * Provide information on hazardous materials use reduction for application to the preparation of use and source reduction plans. The bill provides that the Institute will be governed by a 13 member advisory committee, composed as specified in the bill. This advisory committee is directed to set policies for the Institute and allocate funds to meet the goals and purposes of the Institute. The Hazardous Materials Commission has recommended that the Board of Supervisors indicate its support for AB 1430 since it provides the necessary academic and intellectual backdrop for hazardous waste minimization research and dove-tails with the County' s Hazardous Waste Minimization Program. cc: Assemblywoman Eastin County Administrator Health Services Director Dr. William Walker; Director of Environmental Health Marice Ashe, Staff to the Hazardous Materials Commission
