SUBJECT: Report on Board Referral dated January 30, 1990, Regarding Request for an
Exception from Road Impact Fees from Robert N. Schock

I. RECOMMENDATION
1. Approve the request of Robert N. Schock of 7977 Fairoaks Court, Pleasanton, CA 94588,
for an exception to the $380 fee for the East Central County Travel Corridor Area of
Benefit.
2. Deny similar request of Mr. Schock, for an exception to the$1904 fee for the County-wide
Area of Benefit, East County Region, Marsh Creek Subarea.
3. Authorize Public Works Director to refund to Mr. Schock, the over-payment of$380. BP
#R156520, APN 006-290-003-0
II. FINANCIAL IMPACT
Action on this recommendation will have minor effects on revenue accruals in the East Central County
Travel Corridor Area of Benefit, and the County-wide Area of Benefit.
III. REASONS FOR RECOMMENDATION/BACKGROUND
Mr. Schock is building a home in the Morgan Territory Area, a few miles from the Alameda County line,
and requested that he and others living on the south side of Morgan Territory Road summit be granted
an exception to area of benefit fees because they would not receive any benefits from the improve-
ments to be constructed on State Highway 4 and Marsh Creek Road.

1. Upon checking, it was found that the parcel of land was inadvertently included in the East
Central County Travel Corridor (SR4) Area of Benefit. This matter is being corrected, and
the refund of the fee of $380 is indicated.
2. Every parcel in unincorporated Contra Costa County has been assigned to an Area of
Benefit or a subarea of the Countywide Area of Benefit. This parcel is in the Marsh Creek
subarea of the Countywide Area of Benefit. Care was exercised in assigning parcels to
subareas from which they would acquire the maximum benefit from future road improve-
ments. It can be argued that the degree of benefit varies from parcel to parcel, but no
parcel has been granted a blanket exception, and there is no other suitable area of
benefit subarea for this remote region of Contra Costa County.
IV. CONSEQUENCES OF NEGATIVE ACTION
Negative action could result in establishing a precedent allowing consideration for exclusion of land on
a parcel by parcel basis using degree of benefit as the criteria of judgment. Area of Benefit revenue
would be reduced; fees on remaining parcels would be increased to compensate for the reduction of
revenues; and administrative effort and costs would increase significantly.
