RECOMMENDATIONS
Acknowledge receipt of this report and keep the Board informed of
action taken on the building permit request.
FISCAL IMPACT
None.
BACKGROUND/REASONS FOR RECOMMENDATIONS
. In January of 1990 the Board accepted a report from the Director of
Community Development instructing that staff initiate a rezoning of
the northern Diablo area with the Slope Density SD-1 overlay
District. It was further requested that the Board be informed of
any building permit applications which might be received in the
area prior to adopt of this overlay district.
A request has been received on the Weber property to place a home
on top of a knoll on parcel #194-070-078 .
Currently staff is reviewing the application for conformity with
the conditions on Subdivision 214-78 , reviewing the soils report on
the property, and trying to get from the applicant proof of sewer
and water services.

Wednesday, April 18, 1990 .

SUBJECT: Referral on Permit Requirements for Unprotected Hillsides -
Diablo Area

RECOMMENDATIONS
1. Direct the Community Development Department to institute a
rezoning to the SD-1 overlay district for the northern Diablo
area as shown on the attached map.
2. Until such zoning is in place, request staff to inform the
Board before issuing any building permits in this area which
might be contrary to the intent of this rezoning.
FISCAL IMPACT
The minor costs of processing this overlay zoning district for
notification and mailing.
BACKGROUND/REASONS FOR RECOMMENDATIONS
At the conclusion of the discussion on the Stratmore Subdivision
#6933 , the Board, at the request of Supervisor Schroder, directed
staff to review the approaches which could be utilized to regulate
the placement of homesites in this very sensitive area adjacent to
Mt. Diablo. The concern is that a home may be placed on a parcel,
with only a building permit and the County can' t regulate the home-
site location as we could if a subdivision request wer; applied
for. /

Dear Ms. Drennan,
Thanks for this opportunity to make comments on the proposed additional restrictions to the
existing zoning in the northern Diablo area near Mount Diablo State Park The proposed overlay is a
good addition to administrative oversight in this very sensitive area.
The development proposals which resulted in this rezoning process have the potential of destroying
important views of Mount Diablo,especially along approaches to staging areas and along Mount
Diablo Scenic Boulevard,one of the two major entrances to the State Park It is our understanding,
for example,that a house is proposed for the Weber property,in addition to ones contemplated on
the Stratmore property. A house in the northeastern comer of Weber would sit on an extremely
prominent saddle near Mount Diablo State Park adjacent to an important regional trail,the Green
Valley, (or Las Trampas to Mount Diablo Regional)trail. Other homes in the area have been placed
sensitively to preserve views of the mountain from below and from trails. The ordinance will allow
greater public scrutiny of development plans to ensure sensitive development.
We are encouraged by Supervisor Schroder's intent and the Countys attention to the sensitive
nature of views of Mount Diablo in the limited area treated by the ordinance-they're a good start
However,lands on all sides of Mount Diablo are similarly sensitive. We would encourage the
adoption of this ordinance within a buffer completely surrounding the mountain and would be
willing to work with county staff on a map to be considered for this process.
In the meantime,we urge the adoption of this ordinance,and that staff postpone any building
applications until this ordinance is adopted. Thanks for this opportunity to present comments., I

Also, as a point of his tory, when our family got approval for the
third phase of the adjoining Bryan Ranch subdivision, we took the
easterly most 100 acres, adjacent to the Weber; Property, and
subdivided it into 7 home sites but we accepted the condition that
each home site must be approved by a committee which was comprised
of the Presidents of the Whitegate Homeowner's Association, the
Bryan Ranch Homeowner's Association, and the Green Valley Road
Homeowner's Association. These three Presidents personally
approved each site selection in.order to insure that there would
be no visual impact on the area from the development of our homes.
Each home was subsequently placed so that it would not be seen from
the immediate area and as you are aware, the adjacent easterly
property owned by Mr. Strathmore was subdivided into six home sites
and again with very careful control over site selection.
All of this indicates that there has been a long history of good
will on the part of everyone involved to protect our wonderful
heritage, Mt. Diablo. Being a builder myself, I obviously do not
object to the building of homes. Equally as obvious, there is
ample area to build a number of homes on the Weber Property but
over the past fifteen years the particular area for which a
building permit has been requested has been protected for the
benefit of the community.
Therefore, I am asking the County Staff to continue the good
efforts of so many people over the past fifteen years and uphold
the interests of previous planning decisions to protect Mt. Diablo.
I strongly request that you deny any building permits in the north
easterly quadrant of this property.

Dear Ms. Drennan:
In the process of reviewing the Weber Property building permit
request matter that myself and many others are opposing, I . have
found additional information that I need to convey in order to
supplement my letter dated April 2.
First of all, I would like to specifically direct your attention
to Condition #11 of the above .referenced Subdivision Conditions of
Approval:
"Prior to the issuance of building or grading permits on
Parcel D, the applicant shall submit for review and approval
a specific site development plan showing the location of and
the grading proposed for structures, roads and driveways for
this parcel. "
This condition was specifically put into the Conditions of Approval
in conjunction with an agreement between the original owner of the
subject property, Xl:. Del Rapini, and the Whitegate Homeowner's
Association, who at that time agreed not to compete with Mr. Rapini
for the purchase of the property and to allow a four lot Minor
Subdivision.. The intent of everyone at that time and of the
language incorporated into the Conditions of Apoproval was to
control the location of any building on Parcel D. These intentions
were respected by Mr. Rapini and the Planning Commission even after
a tentative map was filed and that no homes were allowed above the
720 foot elevation. Hence, we feel it appropriate to ask you to
respect and adhere to the Conditions of Approval and the intent of
the Conditions placed on this property by the Staff and Planning
Commission by denying the building permit that has been submitted
for this property.

I have become aware that our San Ramon Valley Regional Planning
Commission could possibly be reviewing on April 18 the SD-1 Overlay
District for the North Diablo Area. This encompasses some 323
acres on the slopes of Mt. Diablo and would require the planning
of home sites in this sensitive area. I am also aware that a
Mr. Weber is applying for a building permit in the northeast corner
of his property at a very high elevation for a 10,000 square foot
home on a very visible parcel.
To begin with, I want you to know that I very strongly support the
SD-1 Overlay and appreciate your sensitivity to the beautiful
countryside that this overlay incorporates. I am sure that many
of my fellow commissioners on the San Ramon Valley Regional
Planning Commission feel the same as I do and welcome the
opportunity to review and support this direction that the Board of
Supervisors has adopted.
However, there is a possibility that the Board may be discussing
their position prior to our Planning Commission receiving this
SD-1 Overlay District for discussion.
I would like you to know that I have personally walked this site
and very strongly oppose the granting of any building in such an
environmentally sensitive area, not to mention the septic tank that
he will need to use. We, as a commission, spent many hours
debating the Strathmore project as it pertained to the same view
corridor and also the split at the end of Diablo View in Diablo.
The Weber Parcel has a long history with the Area Planning
Commission and the various homeowner's associations in the area.
They have always chosen to protect these hillsides. There are
numerous sites that could accommodate a very lovely home on the
Weber Parcel that would not be in conflict with the area wide
community interest.
