Amend March 13 , 1990 Board Order, to exclude $250,000 from recommendation 13 . a) , authorizing proceeds from the Shell Oil spill mitigation settlement to be used for water and wildlife/habitat projects, in order to be consistent with previous Board decisions. FINANCIAL IMPACTS Two hundred and fifty thousand dollars of the Shell Oil spill settlement has already been appropriated to the District Attorney' s budget ( 0242) . Without this revenue in the District Attorney' s budget, a $250,000 budget deficit will occur. BACKGROUND As part of the Fiscal Year 1989/90 budget reduction plan, the Board of Supervisors approved an increase to District Attorney revenue by $250,000 in recognition of revenue to be received from the Shell Oil spill settlement. The District Attorney is responsible for prosecution of environmental law violations, such as the Shell Oil spill, and is therefore an appropriate recipient of this revenue. Goulart PHIL BATCHELOR,CLERK OF THE BOARD OF Water Committee SUPERVISORS AND COUNTY ADMINISTRATOR M382 (10/88) BY DEPUTY -2- The Water Committee recommended that the proceeds from the Shell Oil spill mitigation settlement be used for water and wildlife/habitat projects, and not be deposited in the General Fund. Approval of this recommendation on March 13 , 1990 was contrary to earlier Board approval of the budget reduction plan. This Board Order amends the March 13 action to make it consistent with previous Board decisions. Adoption of this amendment authorizes the Water' Committee to seek Shell Oil spill settlement dollars for wetlands enhancement beyond the $250 ,000 already appropriated.
