SUBJECT: LEGISLATION: SB 2665 (Presley)
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOrIlEMATION:
Adopt a position in SUPPORT of SB 2665 by Senator Presley which
would expand the projects which would qualify for the
supplemental reimbursement provided pursuant to SB 1732 for
capital expenditures for hospitals.
BACKGROUND:
One of the items included in the Board of Supervisors' 1990
Legislative Program was to seek legislation which would broaden
the types of items which can be financed with SB 1732 funds so
that hospital equipment could be included.
Senator Presley has now introduced SB 2665 which accomplishes
what the Board of Supervisors was seeking. Current law provides
as follows: "A hospital qualifying pursuant to subdivision (a)
shall submit documentation regarding debt service on revenue
bonds used for financing , the construction, renovation, or
replacement of hospital facilities, including buildings and fixed
equipment. " SB 2665 strikes the word "fixed" and thereby allows
the financing to include other equipment which is not "fixed" .
SB 2665 also requires the State Department of Health Services to
respond to an applicant for funds within 30 days, indicating that
the project is eligible for financing under SB 1732, The bill
also includes language similar to that which Assemblyman Baker
has already indicated is not required which allows applicants to

request advice letters indicating that plans. are consistent with
State regulations.
The bill also includes other provisions which are probably not
relevant to Contra Costa County. Since SB 2665 would broaden the
types of equipment which Merrithew Memorial Hospital could
finance with its application for SB 1732 funds it is consistent
with the Board' s adopted 1990 Legislative Program. It appears,
therefore, to be appropriate for the Board to indicate its
support for SB 2665.
