SUBJECT: LEGISLATION: SB 2400 (Marks) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMB3NDATION Adopt a position in SUPPORT of SB 2400 by Senator Marks which would prohibit the manufacture, distribution or sale on and after January 1, 1991 of any polystyrene foam food service product or food packaging made with specified chlorofluorocarbons (CFCs) and otherwise regulates the use of polystyrene products made with CFCs. BACKGROUND: Senator Marks has introduced SB 2400 which, as amended March 22, 1990, would do all of the following: 1. Prohibit, on or after January 1, 1991, the manufacture, distribution or sale of any polystyrene foam food service product or food packaging manufactured with CFC-11 or CFC-12 or any fully halogenated CFC. 2. Prohibit, on or after December 31 , 1991, the manufacture , distribution or sale of any rigid polystyrene foam product manufactured with CFC-11, CFC-12 or any fully halogenated CFC if chemical substitutes are commercially available and have been approved by the necessary regulatory agencies. 3 . Prohibit, on or after January 1, 1994, the manufacture, distribution or sale of any nonrigid polystyrene foam product manufactured with CFC-11, CFC-12 or any fully halogenated CFC. Require, beginning January 1, 1991, that manufacturers of the products described above reduce by 25% each year the use and emission of CFC-11, CFC-12 or any fully halogenated CFC. 5. Require, if by February 1 , 1991 , it appears that the December 31, 1991 deadline cannot be met, the manufacturers, distributors or sellers to report to the appropriate policy committees of the Legislature by not later than July 1, 1991 explaining why they cannot comply. To the extent that SB 2400 would tend to outlaw the use of polystyrene products which are manufactured with CFCs from being used in California it appears that 'it is consistent with the Board' s concerns in the area of the environment.
