HomeMy WebLinkAboutMINUTES - 04101990 - 2.1 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA • Adopted this Order on April 10 , 1990 , by the following vote: AYES: SuperviFor.- PowerF , Schroder, TorlakFon, McPeak, Fanden NOES: None ABSENT: None ABSTAIN: None SUBJECT: "Drug Free Zones" within ) RESOLUTION No. 90/ 222 1,000 feet of Contra Costa ) County Public and Private ) Schools ) WHEREAS, the drug epidemic is rapidly growing in the County of Contra Costa, the Bay Area, and throughout the Nation; and WHEREAS, the sale of drugs to children is particularly deplorable in that it is illegal, destroys young lives, and has a disastrous effect on families, communities, and ultimately the future of our nation; and WHEREAS, both California law (Health and Safety Code § 11353 . 6 ) and federal law ( 21 U.S.C. §§ 845 and 845 (A) ) provide for enhanced penalties for persons who distribute drugs to individuals under the age of 21 or who distribute drugs within 1,000 feet of schools; and WHEREAS, the County of Contra Costa may request through the District Attorney or the United States Attorney General for state or federal prosecution of violators of the above-described laws; and WHEREAS, the County of Contra Costa acknowledges that the same issues which justify the establishment of drug free zones around public schools also exist in the areas of private schools; NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of the County of Contra Costa hereby approves and establishes "Drug Free Zones" within 1 , 000 feet of public and private elementary schools, middle schools, junior high schools, and senior high schools in the unincorporated area of Contra Costa County; and BE IT FURTHER RESOLVED that by a copy of this resolution, the Contra Costa County District Attorney and the United States Attorney General will be advised of Contra Costa County's participation in the war against drugs and will be encouraged to prosecute to the maximum extent possible, all drug offenders who violate these "Drug Free Zones" ; and BE IT FURTHER RESOLVED that a copy of this resolution shall be forwarded to the Contra Costa County District Attorney. Adopt the attached Resolution which would establish drug-free zones around each public and private elementary, junior high, middle school and high school in the unincorporated area of Contra Costa County in order to provide for enhanced penalties for those who are convicted of specified controlled substance offenses within 1000 feet of schools. 2. Request the Public Works Director to determine the cost of posting "Drug-Free Zone" signs at appropriate points along the perimeter of each drug-free zone around each school in the unincorporated area of the County which is affected by this Resolution and report his conclusions to the Board of Supervisors. BACKGROUND: The Board of Supervisors has previously asked the County Counsel to prepare the necessary Resolution which would designate a "drug-free zone" around each school in the unincorporated area of the County so that the District Attorney and Attorney General would be encouraged to seek the enhanced penalties which are provided under existing state and federal law for certain specified controlled substance offenses when they occur within 1000 feet of a school.
