RECOMMENDED ACTION:
Amend County Ordinance Code Chapter 470-6' as specified.

FINANCIAL IMPACT:
This amendment has no financial impact.
REASONS FOR RECOMMENDATION:
This amendment will extend the responsibility of take-out food
establishments and fast. food restaurant operators for litter
originating from their premises on public property from
300 feet to 400 feet of any boundary of their premises . The
proposed revised Ordinance #80 was reviewed and approved by
Counsel .

ORDINANCE NO. 90-
(Amend Take-out Food Litter Ordinance)
The Contra Costa County Board of Supervisors ordains as follows
(omitting the parenthetical. footnotes from the official text of
the enacted or amended provisions of the County Ordinance Code) :
SECTION I. SUMMARY. This ordinance amends chapter 470-6 of the
County Ordinance Code, to require owners of take-out food
establishments, including fast food restaurants, to be
responsible for litter originating from their establishments
found on public property within 400 feet, instead of 300 feet, of
the premises .
SECTION II. Section 470-6 .006 of the County Ordinance Code is
amended to read:
490-6 . 006 Litter Nuisance. The owner and/or operator of a
fast food restaurant or take-out establishment shall be
responsible for the deposit of litter, trash or garbage
identifiable as originating from such restaurant or
establishment, on public property within 400 feet of any boundary
of the premises on which such restaurant or establishment is
located.

SECTION III. Section 470-6 .008 of the County Ordinance Code is
amended to read:
470-6 . 008 Nuisance declaration, abatement. Litter, trash
or garbage identifiable as originating from a fast-food
restaurant or take-out establishment on public property within
400 feet of any boundary of the premises on which such restaurant
or establishment is located is hereby declared to be a public
nuisance. In addition to any other remedy provided by law, such
condition may be abated pursuant to Article 14-6 .4, except that
any lien resulting from an abatement shall attach against the
real property upon which the fast-food restaurant or take-out
establishment is located.

SECTION IV. EFFECTIVE DATE. This ordinance becomes effective 30
days after passage, and within. 15 days of passage shall be
published once with the names of the supervisors voting for and
against it in the Contra Costa Times, a newspaper published in
this County.
