PROPOSITION 108, the Passenger Rail and Clean Air
SUBJECT: Bond Act of 1990.
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMENDATION
Adopt a position in SUPPORT of Proposition 108 on the June 5,
1990 ballot which would provide $1 billion in State General
Obligation Bonds to acquire rights-of-way, capital expenditures
and acquisition of rolling stock for intercity rail, commuter
rail and urban rail transit.
BACKGROUND:
Proposition 108 began as AB 973 (Costa) which was enacted into
law as Chapter 108, Statutes of 1989 . AB 973 approves three
separate bond measures. A $1 billion bond measure appears on the
June 5, 1990 ballot as Proposition 108. An addition $1 billion
bond issue will appear on the November 3 , 1992 ballot and a third
$1 billion bond issue will appear on the November 8 , 1994 ballot.
Together these three bond issues total $3 billion. Proposition
108 bonds cannot be issued unless Proposition 111 is also
approved by the voters on June 5 , 1990.
Proposition 108 specifies that the proceeds of the bonds can be
used only for acquisition of rights-of-way, capital expenditures
and acquisition of rolling stock for intercity rail, commuter
rail and urban rail transit and for capital improvements which
directly support rail transportation, including exclusive busways
which are converted within 10 years after completion of
construction into rail lines, grade separations to enhance rail
passenger service and multimodal terminals.

The Board approved the recommendation set forth above.
Later in the day Supervisor McPeak advised that she had some
reservations with supporting Proposition 108 and would like some
additional time to review this measure further. She recommended
that the Board' s previous action be rescinded and that the Board
determine to remain neutral. Board members being in agreement, IT
IS SO ORDERED.

The proceeds of the bonds can be used only for specified routes
and corridors. Those which directly could affect Contra Costa
County include the following:
* Los Angeles-Fresno-San Francisco Bay Area and Sacramento.
* San Francisco Bay Area-Sacramento-Auburn.
* San Francisco-Eureka.
* BART, including the Concord-East Antioch extension and a
possible Richmond-Crockett extension.
* Pleasanton-Concord
At least 150 of the money in the fund must be used for intercity
rail purposes and must be equitably expended on intercity rail
corridors based on the relative population served by each
corridor.
The balance of the portion of AB 973 dealing with Proposition 108
provides for administrative procedures for the sale and repayment
of the bonds. AB 973 also includes essentially identical
provisions for the 1992 and 1994 bond issues.
In view of the need for alternatives to automobile travel,
specifically rail travel, the need to extend BART to East County
and the need to provide a mechanism to finance such alternatives
it is recommended that the Board of Supervisors indicate their
support for Proposition 108 .
