Mudgett In the Walnut Creek Area. This is the time heretofore noticed by the Clerk of the Board of Supervisors for hearing on the recommendation of the Contra Costa County Planning Commission on the application ( 2871-RZ) by Richard L. Mudgett (applicant) and Richard L. and Gail Lee Mudgett (owners) to rezone 11. 8 acres of land from General Agricultural District (A-2) to Single Family Residential District (R-40) in the Walnut Creek area. Supervisor Schroder recommended taking the testimony from all interested parties today and deferring the decision to March 20, 1990 and he also commented on a meeting with the City of Walnut Creek on March 19, 1990. Mary Fleming, Community Development Department, presented the staff report on the request before the Board, describing the site location, compliance with the General Plan, and the staff recommendation to approve the request as recommended by the Planning Commission and rezone to R-40, adopt the Planning Commission findings as set forth at their earlier hearing and introduce the ordinance giving effect to the rezoning. The hearing was opened and the following persons appeared to speak: Richard L. Mudgett, 170 Acacia Way, Coronado, described the proposal for the property, commenting on issues including the role of the City of Walnut Creek relative to this property, and requested a vote in accordance with the General Plan. Supervisor Schroder clarified that the County was not giving up any rights to the City of Walnut Creek or any other public agency, advising of the Board' s policy to receive input from various agencies affected by development within and without their jurisdiction, and that the authority would remain with the Board of Supervisor taking into consideration surrounding neighbors. Mr. Mudgett commented on concerns relative to the City of Walnut Creek. Karl Wandry, Community Development Department, advised that the subdivision itself was not before the Board, just the rezoning request upon which the subdivision approval is contingent. Betty Fairclough, 957 North Gate Road, Walnut Creek, spoke in opposition to the change in zoning. The Chair read into the record a card from Carole Mason, 255 North Gate Road, Walnut Creek, in favor of the approval of the proposal being presented by the North Gate Homeowners' Association petition and a lengthy letter from Ms. Mason was presented for the record. Gail A. Landis, 851 North Gate Road, Walnut Creek, spoke in opposition. i' James Gillivan, 3126 Hackney Lane, Walnut Creek, spoke in opposition, and presented requested changes from the North Gate Homeowners ' Association, and he also presented a petition signed by the North Gate property owners. Alice Applegate, 801 North Gate Road, Walnut Creek, spoke in opposition. Mr. Mudgett spoke in rebuttal. Supervisor Schroder moved to close the public hearing and defer the decision to March 20, 1990 on the Determination calendar.
