RECOMMENDED ACTION a. Approve the attached revised program for individuals convicted for First Offender Driving Under the Influence `. (both Level I and Level II, see Exhibit A and Exhibit B) in accordance with the new legislation SB 1344. b. The 10% administrative fee will be used to "• pay for the additional administrative costs needed to . implement this program. III. REASONS FOR RECOMMENDATION/BACKGROUND ;.. i On March 2, 1982 the Board approved a .program` for individuals convicted for the first time of driving under the influence (DUI) as an alternative to incarceration and license suspension in accordance with AB541, Chapter 940. The result has been a lack of consistency among the counties in California. SB 1344 is an attempt to address these problems. It requires a 3 month 30 hour minimum treatment and education program for all who are arrested and convicted for DUI on or after January 1, 1990. This Program is to be licensed by the State. The proposed program revises our current program in order to comply with SB 1344. Because the nature of the program has changed from education to treatment and it now has complex rules and regulations, additional administrative staff will be necessary to administer and monitor this program. The costs of this additional staff will be derived from the program fees. i PROPOSAL FOR LEVEL I FIRST OFFENDER DRINKING DRIVER PROGRAM COUNTY OF CONTRA COSTA "Provider" "Provider" has provided the Level I First Offender Driving Under the Influence program in Contra Costa since the program began in. 1982 . Consistent with the provisions of SB 1344, "Provider" proposes to expand its existing Level I First Offender Program to 30 hours, including 10 hours of counseling sessions as described herein. Part II - Provider Requirements I . Proposal Elements A. Program Name "Provider" B. Location of Services Services will be provided at: "Provider" address C. Hours of Services To be determined. D. Board Members "Provider" ' Board listed. E. Number of Proposed or Actual Participants Based on the County's estimate, we expect to service approximately 350 program participants annually. II . Participant Management Procedures On referral by the Walnut Creek/Danville and Mt.Diablo Municipal Courts, the participant must contact the Central Referral agency to be assigned to "Provider" to schedule an appointment for an intake interview. On referral from the Bay and Delta Municipal Courts, the participant contacts the provider directly to schedule an appointment for an intake interview. 1 A. Intake Interview Process The intake interview will be conducted before program participation commences, and will include the following: 1. Completion of intake forms required by "Provider", the County, the Department of Alcohol and Drug Programs, the Department of Motor Vehicles, and the courts . 2 . Review and completion of the participant contract. Program staff and the participant will sign and date the contract. The participant will receive the original contract, and "Provider" will retain one copy in the case record. 3. Provision to the participant of a written schedule of program activities, times and location. 4 . An explicit discussion of abstinence as the desired goal for the duration of treatment. 5. Establishment of a participant case folder which will contain all relevant material and documentation. B. Copy of Participant Contract A copy of the participant contract is being developed. C. Participant Attendance Policy and Procedures 1. No person will receive a program completion certificate unless all program requirements have been met and they have actively participated in the program for a minimum of 15 weeks . 2 . Participants will be required to provide an acceptable and documented reason for all absences from regularly scheduled services within seven days . Acceptable reasons are vacations approved in advance, illness, family or employment emergencies, temporary military duty, jury duty or extreme personal hardship. All other reasons will be considered unexcused. Additionally, all missed sessions must be made up, including payment of makeup fee, in order to successfully complete the program. 2 Z 3 . Participants will be allowed a total of 3 absences. A fourth absence will result in dismissal . 4 . Participants will be expected to arrive on time . Those who are more than five minutes late will not be admitted and will be counted as absent. D. Transfers 1. Approval of interprogram transfers will be obtained from Central Referral agency as designated by the alcohol administrator . 2. Notice of transfer on a Department-approved form will be provided to the county alcohol program administrator or designee in both the sending and receiving counties and to the court of conviction. "Provider" may receive participants who went to court outside of Contra Costa through the Central Referral agency. The notice of transfer will include the following information. a. The participant 's full name, address, telephone number and driver 's license number . b. The sending service provider 's name, address, telephone number and license number assigned by the Department. C. The receiving program's name, address, telephone number, and license number assigned by the Department. d. Court information including the name and address of the court, docket number, and probation officer, if assigned. The copy of the' notice of transfer form will be attached. e . Whether the participant was enrolled in the program or is to be considered a new enrollment for Departmental licensing fee purposes. f . Program activities, including the effective date of transfer; the dates of original program enrollment; program fees paid, due and refunded; hours of education and group counseling provided; 3 number of unexcused absences; and time spent on leave of absence or out of program while returned to court. g. Transfer deadline . h. Notification to the participant to contact the new program within 10 working days and failure to participate in the program within 21 days will result in the participant being returned to the court. i . Signatures of the participant, sending county alcohol program administrator or designee, and receiving alcohol program administrator or designee. 3. When "Provider" is the receiving service provider, it will not accept any transferee who cannot commence participation within 21 days following the date of last activity with the sending service provider . 4 . When a program participant is unable to attend a licensed drinking driver program, "Provider" will notify the court of conviction, the Department of Motor Vehicles, and the participant of the participant 's failure to complete with program rules and policies. Such notification will occur within 'seven days of program termination and be submitted on a form furnished or approved by the Department of Motor Vehicles. E. Dismissal Policy and Procedures/Reporting Procedures 1. "Provider" will terminate and refer participants back to the court of conviction for any of the following reasons: a. Four absences for any reason. b. Failure to commence program participation within 21 days of transfer from an approved service provider subsequent to a transfer from an approved service provider . C. Failure to maintain program sobriety. d. Failure to submit to a chemical test pursuant to Section 23157 of the Vehicle Code. 4 e . Failure to comply with "Provider" rules and regulations . f . Failure to comply with additional program . service requirements which have been established by "Provider" and approved by the County and the Department. g. Refusal to pay the assessed program fee . h. Acts of threats of violence and disruptive behavior . i . Loss of contact with the program for 21 consecutive days . 2 . The reason for referral back to court will be documented in participant case records . 3 . "Provider" will notify the court of conviction of each participant who is referred back to court. Such notification will occur within seven days of program interruption and will be reported on a form furnished or approved by the Department of Motor Vehicles . III . Program Service Requirements A. Face-to-Face Interviews 1 . "Provider" will conduct private face-to-face interviews with each participant at least once every other calendar week for the duration of the program. The amount of time spent in each face-to-face session will be documented in each participant 's case record. 2 . Missed face-to-face interviews will be made up before program completion. No participant will receive credit for more than one face- to-face interview per calendar week . 3 . The interviews will be conducted on a regularly scheduled basis and not a drop-in basis . The same interviewer will conduct the interviews for the duration of the program whenever possible . 4 . The purpose of the interviews will be to discuss the participant's progress, to identify related problems which may be barriers to successful completion, to address these issues in a therapeutically appropriate manner, and to assess the need for referral 5 of the participant to ancillary services when appropriate . B. Educational Sessions 1 . Number of hours provided Participants must attend 20 hours of educational sessions . 2 . Curriculum outline a. The curriculum outline is attached (Attachment B) proposal . Educational sessions will be two hours in length and will include both information and discussion of the topics by the participants. b. No education session will exceed two hours within a 24-hour period. C. Any breaks provided to participants during educational session will be in addition to the minimum required hours . d. Attendance and time spent in each educational sessions will be documented in each participant 's case record. 3 . Proposed schedule of service hours The specific schedule for education sessions will be developed when the program is operational . An example 15 week schedule is attached. (Attachment A) 4 . Number of participants per session a. Educational session will be limited to 35 participants. b. Members of the general public will be excluded from educational sessions . 6 C. Group Counseling Sessions. 1. Number of hours provided Participants will attend 10 hours of group counseling. Z. Group counseling process a. Group counseling session will be interactional in nature and be conducted in a manner that encourages participants to identify and resolve alcohol-related problems, provide an opportunity to examine personal attitudes and behavior as reflected in the group process itself, and provide support for positive changes in life style and elimination of alcohol and drug problems . b. Group counseling sessions will not exceed two hours in any week . C. Any breaks provided to participants during the group will be in addition to the minimum required hours . d. Group counseling sessions will be limited to persons who have been convicted of a driving-under the influence offense . 3. Proposed schedule of service hours The specific schedule of counseling sessions will be developed when the program is operational . An example 15 week schedule is attached (attachment A) 4 . Number of participants per session Group counseling sessions will not have more than 15 participants . On an emergency basis, sessions may exceed 15 persons, but they will never exceed 17 persons. 5. Policy and procedure regarding family members "Provider" program will not be open to family members, significant others, or the general public. 7 D. Additional Program Requirements Participants will be required to attend at least 7 outside peer support meetings related to alcohol or other drugs, such as A.A. , C.A. , N.A. , Alanon, and others . E. Ancillary Services "Provider" does not currently propose to provide ancillary services. F. Program Fee Requirements 1. All program fees a. "Provider" will charge only program fees which are recommended by the County Alcohol Program Administrator and approved by the Department . The proposed fee is $312 .00. b. Participants with a documented inability to pay will be provided full program services . If, for any reason, the assessed fee varies from the fee schedule, the reason will be documented in the participant 's case record and approved by the County Alcohol Program Administrator on an individual basis . C. Participants will be provided with a receipt at the time a fee payment is made . d. Each participant will be informed on at least a monthly basis of the amount of fees paid and the balance due . The content of these discussions will be noted in the case folder . e. The maximum downpayment that may be required of a participant will be 20 percent of the assessed program fee . F. A make-up fee of $10 will be assessed for any missed sessions. 2 . Fee Schedule The fee schedule is attached (Attachment C) . It has been developed and approved by the County Alcohol Program Administrator . 8 3. Refund Procedures "Provider" procedure to process and pay refunds, when appropriate, is as follows: a. Departing participants who are transferring to another program may request a refund . This request will be immediately submitted to the "Provider" Finance Division. b. Without a specific request, the program will submit a refund order to the "Provider" Finance Division within 30 days of a participant 's transfer to another program. C. Refunds will be calculated in compliance with the formula set forth in the County Alcohol Program Administrator 's approved fee schedule, a copy of which is attached. 7201 2-20-90 PRODUIPR 9 ATTACHMENT A PROGRAM SCHEDULE AND CONTENT Session 1-Education (2 Hr . ) To create a peer oriented learning environment that includes both experiential and informational formats and to introduce the DUI issue and expectations for the series. Session 2-Education ( 2 Hr . ) To increase the students ' level of awareness of the DUI laws, DMV regulations and insurance costs, an of the impact of drinking and driving on the individual in his/her community and society at large . Session 3-Education ( 2 Hr . ) To provide information and education on the physiological aspects of alcohol and drugs . Session 4- Education ( 2 Hr . ) To provide information and education on alcoholism and addiction. Session 5-Education ( 2 Hr . ) To further continue education on alcoholism and addiction. Session 6- Education ( 2 Hr. ) To provide information and education on the family and co-dependency. Session 7- Education (2 Hr . ) To provide information and education on community aspects of alcohol and other drug problems . Session 8-Education ( 2 Hr . ) To increase the students awareness of the problems created by dysfunctional families, ie; Adult Children of Alcoholics . 1A session 9-Education ( 2 Hr . ) To explore alternatives to the practice of drinking (drugging) and driving and to establish goals incorporating these alternatives. Stress reduction techniques. Session 10-Education ( 2 Hr . ) To provide a recap of the series of highlights (critical points) and to educate and prepare for the upcoming group counseling sessions . Session 11-Group Counseling (2 Hr . ) Share arrest experience and Individuals responsibility in the arrest. Session 12- Group Counseling. ( 2 Hr . ) Share feelings about using alcohol and other drugs . Session 13-Group Counseling ( 2 Hr . ) Share experiences about self help group meetings and share changes in feelings, attitudes, and behaviors since week 1. Session 14- Group Counseling ( 2 Hr . ) Share family dynamics and where client fits Into roles , Session 15- Group Counseling (2 Hr . ) Closure to program. mswl 2-5-90 ATTA 2A ATTACHMENT B The goal of the First Offender Driving Under the Influence Level 1 classes are to educate and inform the offender and to separate the occasion of drinking and/or using drugs from the occasion of driving, and to provide early intervention for problem drinkers and alcoholics . These classes are a direct line of communication with the group who most need this information and are the least likely to seek this information. The classes will illustrate the scope of the problem and make the offender aware of the ramifications of alcohol and other drug use and their responsibility for their actions . The classes will make the offender aware of the resources available in the community which address the problems of alcohol and other drug use and attendant problems. The client will be made aware of their feelings . on a variety of issues and every effort will be made to change attitudes . In recognizing the difficulty in dealing with attitudinal problems, clients will be encouraged to share in group counseling. A maximum of 6 hours of film will be in the entire program. At the completion of the course the offender will have the Information to make intelligent choices and will be aware of the help available for others . DUI LEVEL I (15 Week Program) Sessions for fifteen consecutive weeks for a total of 30 hours consisting of twenty ( 20) hours of education and ten ( 10 ) hours of group counseling. In addition to the base program of education and group counseling, seven (7 ) open Alcoholics Anonymous or other peer support meetings, and seven (7 ) face-to-face, one-on-one counseling interviews will be required. GOAL STATEMENT To separate the occasion of drinking and/or using drugs from the occasion of driving and to provide early intervention for problem drinkers and alcoholics. 1A 12- Session 1 Orientation - Education 2 hours The goal of Class One is to diffuse anger and hostility, introduce the clients to the DUI Program and to build a trust between the instructor and the client to maximize the positive impact of this experience. A. Orientation 1. Brief overview of class 2. Rules 3. Do's and Don'ts of A.A. 4 . Hand out and explain open A.A. Meeting schedules 5. Hand out and explain sign-in sheets 6 . Explanation of the scope of the DUI problem. example : Explain that one-third of the clients will get second DUI arrest. Session 2 DUI and the Law - Education 2 hours The goal of class two is to illustrate that society is taking a new serious stand on DUI, that there are : consequences for their acts aside from the court or DUI schools . In group, to determine clients emotional response if they were to be arrested again for DUI . A. DUI and the Law 1. Duties of the court and probation 2. Where they are/status, etc. Where they stand with DMV and insurance rates . 3. Consequences of subsequent DUIs 4 . Explain implied consent, legal search, road block, point count, clearing your record with the court. 2B 5. Detoxification at a B.A.L. of .015 percent per hour and its ' meaning to future DUIs. 6. Explanation of the alcohol incident and alcohol useage handouts. Session 3 Medical Aspects of Alcohol and Other Drugs - Education 2 hours The goal of Class Three is to illustrate that substance abuse has physical consequences other than injury from accidents, to inform the client of the dangers of the toxic properties of alcohol and other drugs, legal and illegal, to emphasize the physical dangers attendant to loss of control, effect of fetal alcohol syndrome and to draw out from the clients their own personal observations and experiences with the medical tragedies of substance abuse. The short term experience of drinking in their own lives and a commitment to review their own relationship with alcohol . A. Medical aspects of using alcohol and other drugs . 1. Physical effects of alcohol and other drugs . 2 . Fetal Alcohol Syndrome 3. Properties of other psychoactive drugs . 4 . Interaction of alcohol taken in combination with another drug. Session 4 Alcoholism and Addiction Part I - Education 2 hours The goal of Class Four is to provide information and education on alcoholism and addiction thus providing the client with a better understanding of the disease A. Failure to pay the fee by the 10th program session will result in notification to the Court of program failure . 2) I agree to arrive to my assigned Program session ' at the designated time . I understand that if I do not arrive at the designated time or prior, I will not be permitted to attend that session and will be marked ABSENT. 3) I understand that only 3 absences are permitted with a reasonable excuse and that I am required to makeup all absences within the Court progress date. I agree to pay a FEE of $10 for each make-up class and will pay this at the make-up class . 4) I understand that more than 3 absences will result in my being referred back to the Court with a "NOTICE OF PROGRAM FAILURE" . 5) I agree to check in with the attendance instructor at the beginning of the 15 week program series . 6) I AGREE TO REFRAIN from the use of alcohol and other drugs on the day and date that I am scheduled to attend drinking driver class sessions. I UNDERSTAND THAT I WILL NOT BE PERMITTED TO ATTEND CLASS AND WILL BE IMMEDIATELY REFERRED BACK TO THE COURT WITH A NOTICE OF PROGRAM FAILURE, IF THERE IS ANY INDICATION OF THE USE OF ALCOHOL OR DRUGS. Location of Services Services will be provided at: 2400 Sycamore, Su. 36, Antioch, 2366 A Stanwell Circle, Concord, 3043 Research Drive, Richmond. C. Hours of Services 9: 00 AM to 9:00 PM D. Board Members Contra Costa County Board of Supervisors and Alcohol Advisory Board (see attached list) . E. Number of Proposed or Actual Participants Based on the County's estimate, we expect to service approximately 800 program participants annually. II. Participant Management Procedures On referral by the court, the participant must contact the AIRS office to schedule an appointment for an intake interview. A. Intake Interview Process -1- The intake interview will be conducted before program participation commences, and will include the following: 1. Completion of intake forms required by the AIRS Program, the County, the Department of Motor Vehicles, and the courts. 2 . Review and completion of the participant contract. Program staff and the participant will sign and date the contract. The participant will receive the original contract, and AIRS will retain one copy in the case record. 3 . Provision to the participant of a written schedule of program activities, times and location. 4. An explicit discussion of abstinence as the desired goal for the duration of treatment. 5. Establishment of a participant case folder which will contain all relevant material and documentation. B. Copy of Participant Contract A copy of the participant contract is attached. C. Participant attendance Policy and Procedures 1. No person will receive a program completion certificate unless all program requirements have been met and they have actively participated in the program for a minimum of 26 weeks. 2. Participants will be required to provide an acceptable and documented reason for all absences from regularly scheduled services within seven days. Acceptable reasons are vacations approved in advance, illness, family or employment emergencies, temporary military duty, jury duty or extreme personal hardship. : All other reasons will be considered unexcused. Additionally, all missed sessions must be made up, including payment of makeup fee, in order to successfully complete the program. 3 . Participants will be allowed a total of 3 absences. A fourth absence will result in dismissal. 4 . Participants will be expected to arrive on time. Those who are more than five minutes late will not be admitted and will be counted as absent. -2- -2, D. Transfers 1. Approval of interprogram transfers will be obtained from the alcohol administrator. 2. Notice of transfer on a Department-approved form will be provided to the county alcohol program administrator or designee in both the sending and receiving counties and to the court of conviction. AIRS may receive participants who went to court outside of Contra Costa through the Central Referral agency. The notice of transfer will include the following information. a. The participant's full name, address, telephone number and driver's license number. b. The sending service provider's name, address, telephone number and license number assigned by the Department. c. The .receiving program's name, address, telephone number, and license number assigned by the Department. d. Court information including the name and address of the court, docket number, and probation officer, if assigned. The copy of the notice of transfer form will be attached. e. Whether the participant was enrolled in the program or is to be considered a new enrollment for Departmental licensing fee purposes. f. Program activities, including the effective date of transfer; the dates of original program enrollment; program fees paid, due and refunded; hours of education and group counseling provided; g. Transfer deadline. h. Notification to the participant to contact the new program as soon as possible and failure to participate in the program within 21 days will result in the participant being returned to the court. i. Signatures of the participant, sending county alcohol program administrator or designee, and receiving alcohol program administrator or designee. -3- 3. When AIRS is the receiving service provider, it will not accept any transferree who cannot commence participation within 21 days following the date of the last activity with the sending service provider. 4. When a program participant is unable to attend a licensed drinking driver program, AIRS of Contra Costa County will notify the court of conviction, the Department of Motor Vehicles, and the participant of the participant's failure to comply with program rules and policies. Such notification will occur within seven days of program termination and be submitted on a form furnished or approved by the Department of Motor Vehicles. E. Dismissal Policy and Procedures/Reporting Procedures 1. AIRS will terminate and refer participants back to the court of conviction for any of the following reasons: a. Four absences for any reason. A participant who is more than five minutes. late will be charged with an absence. b. Failure to commence program participation within 21 days of transfer from an approved service provider subsequent to a transfer from an approved service provider. c. Failure to maintain progrm sobriety. d. Failure to submit to a chemical test pursuant to Section 23157 of the Vehicle Code. e. Failure to comply with AIRS rules and regulations. f. Failure to comply with additional program service requirements which have been established by AIRS and approved by the County and the Department. g. Refusal to pay the assessed program fee. h. Acts of threats of violence and disruptive behavior. i. Loss of contact with the program for 21 consecutive days. 2 . The reason for referral back to court will be documented in participant case records. -4- 3. AIRS will notify the court of conviction of each participant who is referred back to court. Such notification will occur within seven days of program interruption and will be reported on a form furnished or approved by the Department of Motor Vehicles. III. Program Service Requirements A. Face-to-Face Interviews 1. AIRS will conduct private face-to-face interviews of a minimum 15 minutes with each participant at least once every other calendar week for the duration of the program. The amount of time spent in each face- to-face session will be documented in each participant's case record. 2 . Missed face-to-face interviews will be made up before program completion. No participant will receive credit for more than one face-to-face interview per calendar week. 3 . The interviews will be conducted on a regularly scheduled basis and not a drop-in basis. The same interviewer will conduct the interviews for the duration of the program whenever possible. 4. The purpose of the interviews will be to discuss the participant's progress, to identify related problems which may be barriers to successful completion, to address these issues in a therapeutically appropriate manner, and to assess the need for referral of the participant to ancillary services when appropriate. B. Educational Sessions 1. Number of hours provided Participants must attend 10 hours of educational sessions. 2 . Curriculum outline a. The curriculum outline is attached (Attachment B) proposal. Educational sessions will be two hours in length and will be primarily informational in content. Discussion of the topics by the participants will be encouraged by the instructor. -5- b. No education session will exceed two hours within a 24-hour period. c. Any breaks provided to participants during educational session will be in addition to the minimum required hours. d. Attendance and time spent in each educational sessions will be documented in each participant's case record. 3. Proposed schedule of service hours The specific schedule for education sessions will be developed when the program is operational. An example 26 week schedule is attached. (Attachment A) 4 . Number of participants per session a. Educational session will be limited to 35 participants b. Members of the general public will be excluded from educational sessions. C. Group Counseling Sessions 1. Number of hours provided Participants will attend 30 hours of group counseling. 2 . Group counseling services a. Group counseling session will be interactional in nature and be conducted in a manner that encourages participants to identify and resolve alcohol-related problems, provide an opportunity to examine personal attitudes and behavior as reflected in the group process itself, and provide support for positive changes in life style and elimination of alcohol and drug problems. b. Group counseling sessions will not exceed two hours in any week. C. Any breaks provided to participants during the group will be in addition to the minimum required hours. -6- d. Group counseling sessions will be limited to persons who have been convicted of a driving under the influence offense. 3. Proposed schedule of service hours The specific schedule of counseling sessions will be developed when the program is operational. An example 26 week schedule is attached (attachment A) 4. Number of participants per session Group counseling sessions will not have more than 15 participants. On an emergency basis, sessions may exceed 15 persons, but they will never exceed 17 persons. 5. Policy and procedure regarding family members AIRS will not be open to family members, significant others, or the general public. D. Additional Program Requirements Participants will be required to attend at least 13 outside peer support meetings related to alcohol or other drugs, such as A.A. , C.A. , N.A. , Alanon and others. E. Ancillary Services AIRS will refer clients to other appropriate services as needed, on a case by case basis. F. Program Fee Requirements a. AIRS will charge only program fees which are recommended by the County Alcohol Program Administrator and approved by the Department. The proposed fee is $488.00 b. Participants with a documented inability to pay will be provided full program services. If, for any reason, the assessed fee varies from the fee schedule, the reason will be documented in the participant's case record and approved by the County Alcohol Program Administrator on an individual basis. C. Participants will be provided with a receipt at the time a fee payment is made. -7- w. � d. Each participant will be informed on at least a monthly basis of the amount of fees paid and the balance due. The content of these discussions will be noted in the case folder. e. The maximum downpayment that may be required of a participant will be 20 percent of the assessed program fee. f. A make-up fee at $10 will be assessed for any missed sessions. 2. Fee Schedule The fee schedule is attached (Attachment C) . It has been developed and approved by the County Alcohol Program Administrator. 3 . Refund Procedures AIRS procedure to process and pay refunds, when appropriate, is as follows: a. Departing participants who are transferring to another program may request a refund. This request will be immediately submitted to the Audit Division of Contra Costa County. b. Without a specific request, the program will submit a refund order to the Contra Costa County Audit Division within 30 days of a participant's transfer to another program. C. Refunds will be calculated in compliance with the formula set forth in the County Alcohol Program Administrator's approved fee schedule, a copy of which is attached. 2/5/90 A:AIRS -8- 24, ATTACHMENT A PROGRAM SCHEDULE AND CONTENT Session 1-Education (2 hr. ) To create a peer oriented learning environment that includes both experiential and informational formats and to introduce the DUI issue and expectations for the series. Introduce self help groups. Session 2- Education (2Hr. ) To increase the students' level of awareness of the DUI laws, DMV regulations and insurance costs, and of the impact of drinking and driving on the individual in his/her community and society at large. Session 3-Education (2 Hr. ) To provide information and education on the physiological aspects of. alcohol and drugs. Session 4-Education (2Hr. ) To provide information and education on alcoholism, addiction and co-dependency. Session 5-Education (2Hr. ) To explore alternatives to the practice of drinking (drugging) and driving and to establish goals of incorporating these alternatives. Stress reduction techniques. Group Counseling Sessions Group counseling session will be interactional in nature and be conducted in a manner that encourages participants to identify and resolve alcohol-related problems, provide an opportunity to examine personal attitudes and behavior as reflected in the group process itself, and provide support for positive changes in life style and elimination of alcohol and drug problems. Group counseling sessions will not exceed two hours in any week. Any breaks provided to participants during the group will be in addition to the minimum required hours. Group counseling sessions will be limited to persons who have been convicted of a driving under the influence offense. -1- ATTACHMENT B The goal of the First Offender Driving Under the Influence Level II classes are to educate and inform the offender and to separate the occasion of drinking and/or using drugs from the occasion of driving, and to provide early intervention for problem drinkers and alcoholics. These classes are a direct line of communication with the group who most need this information and are the least likely to seek this information. The classes will illustrate the scope of the problem and make the offender aware of the ramifications of alcohol and other drug use and their responsibility for their actions. The program will make the offender aware of the resources available in the community which address the problems of alcohol and other drug use and attendant problems. The client will be made aware of their feelings on a variety of issues and every effort will be made to change attitudes. In recognizing the difficulty in dealing with attitudinal problems, clients will be encouraged to share in group counseling. A maximum of 6 hours of film will be in the entire program. At the completion of the course the offender will have the information to make intelligent choices and will . be aware of the help available for others. DUI LEVEL I (26 Week Program) Sessions for 26 consecutive weeks for a total of 42.5 hours consisting of ten (10) hours of education and one thirty (30) hours of group counseling. In addition to the base program of education and group counseling, thirteen (13) open Alcoholics Anonymous or other peer support meetings, and thirteen (13) 15 minute, face- to-face, one-on-one counseling interviews will be required plus one (1) intake session. GOAL STATEMENT To separate the occasion of drinking and/or using drugs from the occasion od driving and to provide early intervention for problem drinkers and alcoholics. -2- `j � Session 1 Orientation - Education 2 hours The goal of Class One is to diffuse anger and hostility, introduce the clients to the DUI Program and to build a trust between the instructor and the client to maximize the positive impact of this experience. A. Orientation 1. Brief overview of class 2. Rules 3 . Do's and Don'ts of A.A. 4. Hand out and explain open A.A. Meeting schedules 5. Hand out and explain sign-in sheets 6. Explanation of the scope of the DUI problem. example: Explain that one-third of the clients will get second DUI arrest. Session 2 DUI and the Law - Education 2 hours The goal of class two is to illustrate that society is taking a new serious stand on DUI, that there are consequences for their acts aside from the court or DUI schools. In group, to determine clients emotional response if they were to be arrested again for DUI. A. DUI and the Law 1. Duties of the court and probation 2. Where they are/status, etc. Where the stand with DMV and insurance rates. 3. Consequences of subsequent DUIs. 4 . Explain implied consent, legal search, road block, point count, clearing your record with the court. 5. Detoxification at a B.A.L. of .015 percent per hour and its' meaning to future DUIs. -3- �1 6. Explanation of the alcohol incident and alcohol usage handouts. Session 3 Medical Aspects of Alcohol and Other Drugs - Education 2 hours The goal of Class Three is to illustrate that substance abuse has physical consequences other than injury from accidents, to inform the client of the dangers of the toxic properties of alcohol and other drugs, legal and illegal, to emphasize the physical dangers attendant to loss of control, effect of fetal alcohol syndrome and to draw out from the clients their own personal observations and experiences with the medical tragedies of substance abuse. The short term experience of drinking in their own lives and a commitment to review their own relationship with alcohol. A. Medical aspects of using alcohol and other drugs. 1. Physical effects of alcohol and other drugs. 2. Fetal Alcohol Syndrome 3 . Properties of other psychoactive drugs. 4. Interaction of alcohol taken in combination with another drug. Session 4 Alcoholism and Addiction Part I - Education 2 hours The goal of Class Four is to provide information and education on alcoholism and addiction and co dependency thus providing the client with a better understanding of the disease A.
