SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position in SUPPORT of SB 2025 by Senator Boatwright
which would allow an employee of Contra Costa County who is laid
off due to a reduction in force on and after January 1, 1989 a
period of 365 days within which to obtain employment with another
public agency which has reciprocal retirement benefits with
Contra Costa County' s retirement system.
BACKGROUND:
Under current law an employee who leaves employment with Contra
Costa County has 180 days within which to enter employment with
another public agency which has reciprocal retirement benefits
with Contra Costa County' s retirement system, thereby allowing
the employee to leave his or her retirement contributions on
deposit with Contra Costa County and to defer his or her
retirement until he or she retires from the subsequent employer.
During the lay-offs which occurred in the County in 1989 at least
one employee was laid off and it required more than 180 days
before the employee was able to obtain employment with another
public employer which has reciprocal retirement benefits with the
Contra Costa County retirement system. As a result, the employee
was unable to leave his retirement contributions on deposit and
take advantage of the deferred retirement privileges to which he
would have been entitled if he had obtained such employment
within 180 days.

The employee asked the Contra Costa County Retirement Board to
sponsor legislation which would extend the period of time within
which to obtain employment with another public employer so that
he could leave his contributions on deposit with Contra Costa
County and take advantage of the deferred retirement and other
privileges to which an employee is entitled when he or she
obtains employment with another public agency which has such a
reciprocal arrangement with Contra Costa County.
The Retirement Board agreed to sponsor SB 2025 by Senator
Boatwright. As introduced, SB 2025 would allow an employee 365
days, rather than 180 days, within which to obtain employment
with another public agency which has reciprocal retirement
benefits with Contra Costa County' s retirement system. However,
this provisions is only available to an employee who was laid off
because of a reduction in force and only when the lay-off
occurred on or after January 1, 1989. As introduced, the bill
constitutes a state-reimbursable, state-mandated local program
and provides that reimbursement may be sought through the
Commission on State Mandates.
Since the bill provides a mechanism by which the increased costs
of the bill can be recovered from the state and since the bill is
being sponsored by the Retirement Board it appears to be
appropriate for the Board of Supervisors to indicate its support
for SB 2025.
