Contra FROM: Phil Batchelor, County Administrator � ' � ,'s Costa February 26 , 1990 o .., �' County DATE: Sr------- SUBJECT: LEGISLATION: AB 1332 (Peace) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOPMEMATION: Continue the Board' s position of SUPPORT for AB 1332 by Assemblyman Peace which would prohibit certification of any motor vehicle of a 1995 or later model year which has an air-conditioning system that uses CFCs. BACKGROUND: On February 27 , 1990 the Board of Supervisors voted to support AB 1332 by Assemblyman Steve Peace. The bill has been amended again. Existing law prohibits a motor vehicle on a highway which does not comply with emission control equipment requirements. Existing law does not regulate the use of CFC' s in motor vehicle air conditioning systems, but requires the State Air Resources Board to evaluate programs to reduce CFC emissions from motor vehicle air-conditioning systems. AB 1332 , as amended January 22 , 1990 , continues to prohibit the State Air Resources Board from certifying a 1995 or later model .year motor vehicle which has an air-conditioning system that uses CFCs. The bill would also prohibit any person from installing, selling or offering to sell an air-conditioning system which uses CFC' s and is intended for use on a 1995 or later model year motor vehicle. Jackson, Barish & Associates The State Air Resources Board may, by regulation, delay the motor vehicle model year to which this prohibition applies upon a finding that there is no economically or technologically feasible alternative air-conditioning system which does not use CFCs. By January 1, 1993 and at least once annually thereafter, the State Air Resources Board would be required to make a finding as to whether an individual motor vehicle model will be in violation of the prohibition beginning in the 1995 model year if the individual motor vehicle model continues to be equipped with an air-conditioning system which uses CFO' s. The January 22 , 1990 amendment added the phrase "if the individual motor vehicle model continues to be equipped with an air-conditioning system which uses CFCs" to clarify that no such finding need be made if the model no longer is equipped with air-conditioning systems which use CFCs. The Board is to make this finding public and within 30 days of making the finding, must notify affected motor vehicle manufacturers of the finding. The January 22, 1990 amendments add definitions of "air-conditioning system" and "chlorofluorocarbons" for purposes of the bill. It appears that passage of AB 1332 as amended January 22, 1990 would continue to further the Board of Supervisors ' environmental goals and it is therefore recommended that the Board indicate their continued support of AB 1332.
