RAINEY, SHERIFF-CORONER County i DATE: 14 MARCH 1990 SUBJECT: RENEWAL OF CARDROOM LICENSE SPECIFIC REOUEST(S)OR RECOMMENDATION(S)f BACKGROUND AND JUSTIFICATION RECOMMENDATION Approve renewal of Cardroom License No. 3, known as "Shorty's Bar and Patio" (former "Della Pipa's) , located at 2396 Pacheco Boulevard, Pacheco, California, for the period of 19 December 1989 through 19 December 1990, with the conditions as follows: Will not allow live music to be played past 10:00 p.m. The only exceptions would be New Year's Eve and the Fourth of July, where live music will be no later than 12 : 30 a.m. . BACKGROUND AND JUSTIFICATION An application was submitted by Mr. and Mrs. Ray Stetler for renewal of Cardroom License No. 3, known as "Shorty's Bar and Patio" , on 11/17/89. Reference: County Ordinance No. 82-44, Chapter 52-3, Article 1, para. 52-3 . 321 and 52-3.317 The Sheriff conducted the usual background investigation and as a result of this investigation, this office found no detrimental information that would preclude approval of said application and that the facts are such that a hearing was not necessary; however, on January 30, 1990, "The Board continued this matter subsequent to a meeting held with Supervisor Fanden and staff of the County Administrator, Community Development Department, and the Sheriff and neighbors to resolve concerns of the neighborhood" . The Sheriff's Department Patrol Division did respond and deal with each situation. At each of these loud music contacts, the music was lowered, and the establishment personnel were cooperative with the Deputies. Sinee the last incident on 12/30/89, the Sheriff's Department has not received any complaints of loud music. As a result of these complaints, Mr. Stetler constructed a fully enclosed insulated area where bands perform; further, Mr. Stetler offered to limit the playing of music to the times proposed. . Mr. Stetler understands the Sheriff is recommending conditions that will limit the playing of music, as a condition on his cardroom license. FINANCIAL IMPLICATION The County collects $500. 00 application fee and $500. 00 license fee for one table. SIONATURE:
