DATE: March 21, 1990 SUBJECT: LEGISLATION: SB 2305 (Ayala) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOPMENDATION Adopt a position in SUPPORT of SB 2305 by Senator Ayala which would increase the amount of money going into the Sheriff ' s Laboratory Fund from fines and forfeitures imposed on individuals convicted of driving under the influence and other related offenses. BACKGROUND: Under current law, $50 for each conviction of driving under the influence is credited to the Sheriff ' s Laboratory Fund to be used exclusively to pay for the cost of performing analysis of the blood, breath or urine for alcohol content or for the presence of drugs. Assemblyman Campbell was successful several years ago in getting legislation passed which would authorize the court in Contra Costa County, upon the order of the Board of Supervisors, to impose an additional assessment on each of these convictions in order to cover the cost of the funds which were being diverted to the Sheriff ' s Laboratory Fund. Senator Ayala has now introduced SB 2305 which would increase the amount to be allocated to the Sheriff ' s Laboratory Fund from $50 to $100 and would allow the board of supervisors in any county to impose a $50 assessment to assist in covering the costs of the fines and forfeitures thus diverted to the Laboratory Fund.
