SUBJECT: LEGISLATION - SB 1231 (McCorquodale)
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION-
Adopt a position of SUPPORT for SB 1231 by Senator McCorquodale
(as amended February 15 , 1990) which would recast and increase
various penalties for possession of varying amounts of specified
controlled substances and other related offenses.
BACKGROUND-
Existing law specifies the punishment for the unlawful possession
of specified controlled substances depending on the nature of the
substance and the amount of the substance.
SB 1231 by Senator McCorquodale, as amended February 15, 1990 ,
would do all of the following:
1. Make it a felony, punishable by imprisonment in the state
prison for 2, 3 , or 4 years, for any person to possess one
gram or more of a substance containing cocaine, cocaine
base, amphetamine or methamphetamine.
2. Make it a felony, punishable by imprisonment in the state
prison for 2, 3 , or 4 years, for any person to possess 1/10
of a gram or more of a substance containing heroin.
3 . Make it a felony, punishable by imprisonment in the state
prison for 2, 3 , or 4 years, for any person to possess any
liquid form of phencyclidine (PCP) .

4. Make it a felony, punishable by imprisonment in the state
prison for 2 , 3 , or 4 years, for any person to possess four
or more cigarettes containing phencyclidine (PCP) .
5. Increases the period of imprisonment for possession for sale
or purchase for the purpose of sale of a wide variety of
controlled substances from 2 , 3 or 4 years to 2, 4 , or 6
years.
6. Increases the period of imprisonment for possession for sale
or purchase for the purpose of sale of cocaine base from 3,
4, or 5 years to 2, 4 , or 6 years.
7. Increases the period of imprisonment for possession for sale
of phencyclidine (PCP) from 3 , 4, or 5 years to 2, 4 , or 6
years.
8 . Adds to the list of offenses for which probation cannot be
granted and the execution or imposition of the sentence
cannot be suspended when the individual has been convicted
previously of a variety of controlled substance offenses,
felony conviction for the sale, possession for sale or
possession of controlled substances on the grounds of or
within any school during hours when the school is open for
classes or school-related programs or on the grounds of a
public playground during the hours when school-related
programs for minors are being conducted.
9. Require a court to confine a juvenile to a locked facility
for 30 days if the juvenile has been found to be a person
who is under the jurisdiction of the juvenile court for
unlawfully possessing, possessing for sale or selling
controlled substances which constitutes a felony and would
extend this provision to possession of controlled substances
on the grounds of a public playground during the hours when
school-related programs for minors are conducted.
Since SB 1231 increases the punishment for a variety of
controlled substance offenses and adds more offenses to the
existing punishments, the bill appears to be consistent with the
Board of Supervisors ' war on drugs. It is therefore recommended
that the Board of Supervisors indicate its support for SB 1231.
