Code § 25526.6) SUBJECT: Conveyance of Storm Drain Easement to City of Pinole Pinole Creek Project No. 7532-6D8374 Pinole Area The Board of Supervisors, as the Governing Body of Contra Costa County Flood Control and Water Conservation District, RESOLVES THAT: The District acquired the real property described in Exhibit "A" attached hereto, by deeds recorded on February 24, 1958, in Volume 3125 at page 330 and May 12, 1966, in Book 5119, page 370, in the Pinole area, for flood control purposes. The City of Pinole has requested an easement for storm drain purposes. This Board FINDS that the conveyance of such easement is in the public interest and will not substantially conflict or interfere with the District's use of the property. This Board hereby APPROVES and AUTHORIZES the conveyance of an easement to the City of Pinole, over the property described in Exhibit "A" attached hereto, pursuant to Government Code § 25526.6, and the Board Chair is hereby AUTHORIZED to execute a Grant of Easement on behalf of the District. The Real Property Division is DIRECTED to cause said Grant of Easement to be delivered to the grantee. This activity is not subject to the California Environmental Quality Act pursuant to § 15061 (b) (3) of Chapter 3 of the CEQA Guidelines, as it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment and is in conformance with the City of Pinole's general plan. ED-744 10-86 Contra Costa County Flood Control & Water Conservation District to City of Pinole EXHIBIT "A" Parcels X2-18 and X44-3: Easement for storm drain pipe and manhole maintenance (excluding maintenance of rock riprap channel slope protection). Easements on, over, under, and across the following described real property being portions of those parcels of land granted to Contra Costa County Flood Control and Water Conservation District as PARCEL ONE recorded February 24,_1958 in Volume 3125 at page 330 and PARCELS 44 and 44C recorded May 12, 1966 in Volume 5119 at page 370. Document and map references are to records of Contra Costa County. Commencing at "Point 2-Z" as described in the recording of said PARCEL 44; thence South 820 39' 00" West 65.00 feet to the west line of said PARCEL 44; thence along said west line, North 070 21' 00" West 61.93 feet, more or less, to the centerline of an existing storm drainage pipe, being the true point of beginning. A 10.00, feet wide strip of land, the centerline of which is described as follows: Thence from said true point of beginning along the centerline of said storm drainage pipe, North 840 05' 04" East 7.65 feet, more or less, to the center of an existing storm drainage manhole and North 840 05' 04" East 40 feet, more or less, to the end of said storm drainage pipe being the terminus of herein described strip of land. Containing 477 square feet, more or less, being 0.011 acres. Parcels X2-19 and X44-4: Easement for storm drain pipe and manhole maintenance purposes (excluding maintenance of rock riprap pipe spillway for earth channel). Commencing at "Point 2-R" as described in the recording of said PARCEL 44; thence South 640 25' 27" West 70.00 feet to an angle point in the west line of said PARCEL 44; thence along said west line, South 250 34' 33" East 149.85 feet, more or less, to the centerline of an existing storm drainage pipe, being the true point of beginning. A 10.00 feet wide strip of land, the centerline of which is described as follows: Thence from said true point of beginning, along the centerline of said storm drainage pipe, South 89° 23' 09" East 4.39 feet, more or less, to the center of an existing storm drainage manhole and North 450 15' 23" East 51 feet, more or less, to the end of said Page 1 of 2 storm drainage pipe being the terminus of herein described strip of land. Commencing at Contra Costa County Flood Control and Water Conservation District monument #7094 marking an angle point in the westerly boundary of PARCEL 44 that bears South 640 25' 27" West 65.00 feet from "Point 2-P" as described in the recording of said PARCEL 44; thence along said boundary, South 640 25' 27" West 10.00 feet, North 250 34' 33" West 22.83 feet, and along the arc of 175 foot radius curve concave to the southwest through a central angle of 020 33' 14", Northerly 7.80 feet, more or less, to the centerline of an existing storm drainage pipe, being the true point of beginning. A 10.00 feet wide strip of land, the centerline of which is described as follows: Thence from said true point of beginning, along the centerline of said storm drainage pipe, North 660 42' 59" East 18.42 feet, more or less, to the center of an existing storm drainage manhole and North 660'42' 59" East 37.00 feet, more or less, to the end of said storm drainage pipe being the terminus of herein described strip of land.
