HomeMy WebLinkAboutMINUTES - 03271990 - 1.1 (2) 64/ THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on March 27, 1990 by the following vote: AYES: Supervisors Powers , Schroder, McPeak, Torlakson & Fanden NOES: None ABSENT: None ABSTAIN: None RESOLUTION No. 90/192 SUBJECT: Approval of the Final Map and Subdivision Agreement for Improvement Warranty for Subdivision 7306, WC/Alamo Area. The Public Works Director having notified this Board that the improvements for Subdivision 7306, being developed by Sasha Maloff and Paul Doble have been completed and that such improvements, have been constructed without the need for a Subdivision Agreement; The following documents were presented for Board approval this date: The Final Map of Subdivision 7306, property located in the WC/Alamo Area,' said map having been certified by the proper officials. A Subdivision Agreement for improvement warranty with Sasha Maloff and Paul Doble, subdivider, whereby said subdivider agrees to satisfy any valid claims of liens of labor and materials as to the said improvements and subdivision appearing hereafter upon demand by the County as required in said Subdivision Agreement for Improvement Warranty within six months from the date of said agreement. Said documents were accompanied by: I. Security for labor and materials for the six-month lien guarantee period as required by Title 9 of the County' Ordinance Code, in the form of a cash deposit (Auditor's Deposit Permit No. 170428, dated March 16, 1990) in the amount of $7,700 . for labor and materials made by Sasha Maloff. II. Letter from the County Tax Collector stating that there are no unpaid County taxes heretofore levied on the property included in said map and that the 1989-90 tax lien has been paid in full and the 1990-91 tax lien, which became a lien on the first day of March, 1990, is estimated to be $1,800. III. Security to guarantee the payment of taxes as required by Title 9 of the County Ordinance Code, in the form of a cash deposit (Auditor's deposit Permit No. 170082 dated March 9, 1990) made by Paul Doble in the amount of $1,800 guaranteeing the payment of the estimated tax; NOW THEREFORE BE IT RESOLVED that said subdivision, together with the provisions for its design and improvement, is DETERMINED to be consistent with the County's general and specific plans. BE IT FURTHER RESOLVED that said Final Map is APPROVED and this Board does not accept or reject on behalf of the public any i of the streets, paths, or easements shown thereon as dedicated to public use. i RESOLUTION NO. 90/192 Approve Final Map and Agreement for Subdivision 7306 March 27, 1990 Page 2 of 2 BE IT FURTHER RESOLVED that said Subdivision Agreement for improvement warranty is also APPROVED. BE IT FURTHER RESOLVED that the improvements have been completed as of March 9, 1990 thereby establishing the six-month terminal period for the filing of liens in case of action under said Subdivision Agreement for Improvement Warranty. BE IT FURTHER RESOLVED that the $7 ,700 cash security for labor and materials (Auditor's Deposit Permit No. 170428, dated March 16, 1990 deposited by Sasha Maloff be RETAINED for the six- month lien guarantee period until September 9, 1990, at which time the Public Works Director is AUTHORIZED to refund the cash security less the amount of any claims on file.
