SUBJECT: San Ramon Creek Bypass - Phase III

SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. APPROVE Right of Way Contract and ACCEPT Grant Deed dated February 27, 1990 from
1400 Creekside Apartment Owners, Inc.
B. AUTHORIZE Chief Engineer to execute said Right of Way Contract on behalf of the
District.
C. APPROVE payment of $ 16,250 for said property rights and AUTHORIZE the Auditor-
Controller to issue a check in said amount payable to Founders Title Insurance Company,
Escrow No. 873565, to be forwarded to the Real Property Division for delivery.
D. DIRECT the Real Property Division to have the above referenced Grant Deed recorded
in the office of the County Recorder.
E. ACCEPT Quitclaim Deed from 1400 Creekside Apartment Owners, Inc., et al., to clear the
cloud on the title of the property being acquired. DIRECT the Real Property Division to
have the Quitclaim Deed recorded with the above referenced Grant Deed.
II. Financial Impact:
Payment of $16,250 from Flood Control Zone 3B funds which are 100% reimbursable from
California Department of Water Resources.

III. Reasons for Recommendations and Background:
These property rights are required for the San Ramon Creek Bypass project in accordance with
approved plans and specifications.
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow construction in accordance with the
approved plans and specifications.
