SUBJECT: MAJOR NARCOTIC VENDOR PROSECUTION (MNVP) PROGRAM, CONTRA COSTA DA-NET
RESOLUTION OF THE GOVERNING BOARD 90/ 161
WHEREAS the Board of Supervisors, Contra Costa County, desires to undertake a certain
project designated CONTRA COSTA DA-NET, to be funded in part from funds made
available through the Major Narcotic Vendor Prosecution (MNVP) Program administered
by the Office of Criminal Justice Planning (hereinafter referred to as OCJP).
NOW, THEREFORE, BE IT RESOLVED that the District Attorney of the County of Contra
Costa is authorized, on its behalf to submit the attached proposal to OCJP and is
authorized to execute on behalf of the Board of Supervisors the attached Grant Award
Agreement including any extensions or amendments thereof.
IT IS AGREED that any liability arising out of the performance of this Grant Award
Agreement, including civil court actions or damages, shall be the responsibility of
the grant recipient and the authorizing agency. The State of California and OCJP
disclaim responsibility for any such liability.
BE IT FURTHER RESOLVED that grant funds received hereunder shall not be used to
supplant expenditures controlled by this body.

SUBJECT: Approval For Submission and Execution of Contract With the State Office of
Criminal Justice Planning For Funding of Contra Costa DA-NET (Major Narcotic
Vendor Prosecution Program) For the Period July 1, 1990 to June 30, 1991
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
I. RECOMMENDED ACTION
Authorize the District Attorney to submit an application and execute a
grant award contract with the State Office of Criminal Justice Planning for
funding of Contra Costa DA-NET (Major Narcotic Vendor Prosecution Project)
for the period July 1, 1990 to June 30, 1991, in the amount of $125,000
(state funds - budgeted).
II. FINANCIAL IMPACT
This grant contact will be in the amount of $125,000 to fund salaries and
benefits for an attorney and an investigator for the project. This will be
the third year of State funding. Revenue will be built into the District
Attorney's 1990/91 budget to implement the grant.
III:' REASONS FOR RECOMMENDATION/BACKGROUND
The goal of this project is to enhance prosecution of major drug dealers,
producers, and distributors through vertical-prosecution, thereby
increasing the likelihood of convicting offenders and ensuring appropriate
sentences for such offenders. Chapter 1424, Statutes of 1984, authorized
this State program and set forth basic guidelines for the program. A case
qualifies for the program if the defendant is charged with one of the
enumerated offenses and is a financier of an illegal drug operation, a
laboratory operator, a wholesaler, a head of a criminal organization
involved in the sale or distribution of illegal drugs, the head of a
structured drug distribution organization, or a ,cultivator, distributor,
retailer, or key conspirator in a case involving significant amounts of
illegal drugs. State policies require project staff to use all reasonable
prosecutorial efforts to resist pretrial release of eligible defendants, to
persuade the court to impose the most severe sentences authorized upon
conviction, and to reduce the time between arrest and disposition of
charges. Juvenile offenders may not be the subjects of prosecution by this
grant program.
In the last year, the project attorney and investigator team disposed of 24
cases against major narcotics dealers, manufacturers, distributors, etc.
Of these, 22 were convicted and sent to state prison or jail , one died
before adjudication, and one was placed in a drug diversion program by a
judge.
