EXPRESSING APPRECIATION TO ASSEMBLYMAN BAKER FOR HIS
SUBJECT: INTERVENTION WITH THE STATE DEPARTMENT OF HEALTH
SERVICES ON BEHALF OF MERRITHEW MEMORIAL HOSPITAL
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1 . Authorize the Chair to sign a letter to Assemblyman William
P. Baker, expressing the appreciation of the Board of
Supervisors for Assemblyman Baker' s intervention with the
State Department of Health Services on behalf of Merrithew
Memorial Hospital in clarifying that the State Department of
Health Services will agree to provide an advanced review of
the County' s application for funds for the reconstruction of
Merrithew Memorial Hospital.
2. Amend the Board' s 1990 Legislative Program to remove item #
4 from that Program on the basis that it has been
successfully resolved administratively and will not require
legislation.
BACKGROUND:
As the Board of Supervisors is aware, one of the principal
sources of proposed funding for a replacement hospital for the
County is the funding available under SB 1732, whereby the County
can apply for funding for capital expenditures equivalent to that
percentage of the hospital' s population which is represented by
Medi-Cal patients.
The provisions of SB 1732 require that the County, in order to be
eligible for SB 1732 funds, must apply to be an eligible project
at the time that the County is ready to have final plans approved

by the Office of Statewide Health Planning and Development. Of
course, this would require that the Board of Supervisors commit
substantial funds and time into preliminary work designing the
hospital before we would have any idea whether the plans would be
eligible for SB 1732 funding.
At the request of the Health Services Director, an item was
included in the Board' s 1990 Legislative Program to seek
legislation which would authorize the State Department of Health
Services to provide an advanced advice letter to the County to
let us know whether our preliminary work was in line with the
State' s guidelines for SB 1732 funds. It did not appear that the
State had statutory authority to provide such an advanced
indication to the County.
Prior to agreeing to introduce legislation on this subject,
Assemblyman Baker asked that the County prepare a letter to the
State Department of Health Services which he could send to
clarify whether such legislation was in fact necessary.
The State Department of Health Services has indicated to
Assemblyman Baker that legislation would not be necessary and
that the State would- be happy to provide the County with the type
of advanced review requested by the Health Services Director. By
obtaining such an administrative determination from the State
Department of Health Services, Assemblyman Baker has avoided the
need for legislation on this subject and has made it possible for
the County to obtain a much earlier review of our proposed
project than would have been possible otherwise.
It is therefore recommended that the Board of Supervisors
authorize the Chair to express the Board' s appreciation to
Assemblyman Baker and amend the 1990 Legislative Program
accordingly.
