REASONS FOR RECOMMENDATION%BACKGROUND
At their meeting on March 5 , 1990, the Board of Supervisors '
Water .Committee considered each of the proposed legislative bills
and examined the rationale that justified the above-stated
positions for consistency with the County' s established water
policy. A summary of _the bills and rationale for County
positions are on file with the Community Development Department.

POSITIONS OF THE CONTRA COSTA WATER AGENCY
ON SELECTED 1990 WATER LEGISLATION
(FOR BOARD OF SUPERVISORS' CONSIDERATION MARCH 13, 1990)
AB 2661 - Klehs - Water Management Planning
Summary
This legislation enables the Urban Water Management Act currently in effect
until January 1, 1990 to become a permanent, state-mandated program through
deletion of the above termination date. This program requires local' agencies
providing either 3,000 customers or more than 3,000 acre-feet of water annually
to develop an Urban Water Management Plan. The plan would include assessments
of water use, conservation measures, deficiencies, future use, data collection
and implementation plans.
Recommended Position
Support.
Rationale
Specified components of this plan are in accordance with County policy regarding
water conservation, and provide a method of implementation throughout the state.
AB 2681 - Kelley - Water Reclamation Office
Summary
This bill would create an Office of Water Reclamation within the Department of
Water Resources to promote the use of reclaimed water by providing assistance to
local agencies.
Recommended Position
Support.
Rationale
This legislation is consistent with current County water reclamation policy.
AB 2871 - Costa - Groundwater Management
Summary
This legislation would allow agencies with specified groundwater basins subject
to critical overdraft situations to initiate a Groundwater Management Program.
This program may establish and collect rates for groundwater use and/or require
an assessment for water recharge, subject to voter approval.
Recommended Position
Support.
Rationale
This bill would allow local agencies to recoup expenses incurred from
groundwater management practices _and may spur other water conservation
procedures.
AB 2872 - Costa - Water Quality: Investigations
Summary
This legislation provides for estuarine waters to be specifically included in
Department of Water Resources water quality investigations of state waters.
Recommended Position
Support.
Rationale
This bill is consistent with County policies regarding water quality and
Bay-Delta preservation.
SB 1845 - Torres - Water Quality; Bay and Ocean Discharge Fees
Summary
This legislation requires appropriate fees to be established by the State Water
Resources Control Board for dischargers which discharge wastes into enclosed
bays and estuaries. Fees would be based upon amount and toxicity of wastes
discharged (not to exceed $5 million) , and would be used to fund activities such
as the identification, ranking and cleanup plans of toxic hot spots within
bay-estuary areas.
Recommended Position
Support.
Rationale
It would seem appropriate that dischargers be responsible for water quality
problems resulting, in part, from waste discharges. This bill is consistent
with County water quality objectives.
