THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on March 13, 1990 by the following vote:
AYES: Supervisors Powers, McPeak, Torlakson and Fanden
NOES: None
ABSENT: Supervisor Schroder
ABSTAIN: None

SUBJECT: Hearing On Rezoning Application 2863-RZ By Robert McKee,
Et Al, Alamo Area.
This is the time heretofore noticed by the Clerk of the Board of
Supervisors for hearing on the recommendation of the San Ramon Valley
Regional Planning Commission on the request ( 2863-RZ) by Robert D.
McKee, et al' (applicants and owners) to rezone land from Single Family
Residential (R-20) to Single Family Residential (R-40) in the Alamo
area.
Robert Drake, Community Development Department, presented the
staff report on the request before the Board for consideration today.
He commented on the recommendation by the Planning Commission for
approval of the R-40 zoning.
Supervisor Powers questioned whether there was litigation
involved in this matter.
Victor Westman, County Counsel, responded that there is
litigation pending on the Park minor subdivision application, and
advised of remarks made by the applicant' s attorney on that
application that it would have little impact on the neighborhood as he
understood it, that the area was going to be proposed for the General
Plan to impose larger parcel sizes and there would not be further
breakdowns in the area. Mr. Westman advised that this litigation would
not prevent action on this application.
The public hearing was opened and the following persons appeared
to speak:
Tim Tinnes, 200 Wayne Avenue, Alamo, spoke in favor of the
requested rezoning.
Robert McKee, 225 Wayne Avenue, Alamo, representing most of the
people on Wayne Avenue, spoke in favor of the requested rezoning.
Alan Moore, Thiessen, Gagen & McCoy, 279 Front Street, Danville,
representing Philip Park, spoke in opposition.
The following person submitted comments for the Board' s
consideration but did not wish to speak:
Scott P. Tiernan, 909 Danville Boulevard, Alamo.
Mr. McKee spoke in rebuttal.
The public hearing was closed.
Supervisor Powers recommended that this matter be put over for
one week on the Determination calendar.
IT IS BY THE BOARD ORDERED that the decision on Rezoning
Application 2863-RZ is DEFERRED to the March 20, 1990 Determination
Calendar.
Supervisor Torlakson requested County Counsel review the legal
issue in terms of compatibility with the General Plan.
