HomeMy WebLinkAboutMINUTES - 03131990 - T.6 T. 6 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on March 13 , 1990 by the following vote: AYES: Supervisors Powers, McPeak, Torlakson and Fanden NOES: None ABSENT: Supervisor Schroder ABSTAIN: None --------------------------------------------------------------------- --------------------------------------------------------------------- SUBJECT: Hearing On Rezoning Application 2824-RZ and Subdivision 7232; And Appeal By Garry Mello Et Al On Rezoning Application 2824-RZ And Subdivsion 7232 In The Oakley Area. This is the time heretofore noticed by the Clerk of the Board of Supervisors for hearing on the recommendation of the East County Regional Planning Commission on the request ( 2824-RZ) by Bellecci and Associates (applicants) and Richard Cagle and Anita Adams (owners) to rezone land from General Agricultural (A-2) to Single Family Residential (R-12) ; and to consider the appeal by Gary Mello, et al from the decision of the East County Regional Planning Commission on the request to rezone land ( 2824-RZ) by Bellecci and Associates and Richard Cagle and Anita Adams and the request for approval to subdivide 5. 0 acres into ten lots (Subdivision 7232) in the Oakley area. Byron Turner, Community Development Department, presented the staff report on the matters before the Board today, describing the proposed project location, and the revised map that had been presented today. Supervisor Torlakson commented on the meetings over the past several years on this project, and he requested whether various items had been incorporated into the conditions and if they had been agreed to including a landscaping easement, a minimum five foot fence set back with the landscaping to be outside of the project, landscaping area to be designated for landscaping only, landscaping and irrigation to be installed by professional landscapers at the expense of the developers, landscaping to be large growing evergreen trees planted close enough to provide screening and buffering in a two year period, and the masonary fence. He requested clarification on whether the issue of the parcels adjacent to Mello and Tate being limited to single story was a part of the consensus as requested in a letter from Mr. Mello. He commented on issues in Mr. Mello' s letter dated March 11, 1990, including land elevation changes. Mr. Turner commented that those matters did not appear to have been incorporated into the conditions before the Board today for consideration. Supervisor Torlakson indicated that there would have to be direction added to incorporate those if they were not in there now. The public hearing was opened and the following persons appeared to speak: Frank Bellecci, Bellecci and Associates, 2552 Stanwell Drive, Concord, representing the owners, commented on the revised map, including the five foot landscaping easement, the drainage line, the reconfiguration of the lots to be more regular in shape, and the land elevation changes. Gary Mello, Rt. 1 Box 224-C, Gum Tree Lane, Oakley, appellant, commented on issues including the density, lot sizes, buffering, the masonary fence, the landscaping, single story homes, and land elevation changes. Mr. Bellecci spoke in rebuttal. The public hearing was closed. Supervisor Torlakson expressed intent to approve the project with the compromise outlined in Mr. Mello' s letter including the extension of the wall to Tate Lane so that there is a completion of the wall, the masonary fence type structure, and that the final type of structure should be reviewed with the developer' s and the existing neighbors ' input before the Zoning Administrator makes a final decision on the matter, and that on the land elevations indicate that the Zoning Administrator and the applicant should make every effort in reviewing the engineering to avoid major elevation changes, and that the final approval of that review would be done by the Zoning Administrator, and the road alignment be fully reflected in the conditions and the final map. He expressed intent on that and moved approval that these things be incorporated in the final language and conditions and requested that the matter be placed on the March 27 , 1990 Determination calendar for final approval. IT IS BY THE BOARD ORDERED that the Board DECLARES ITS INTENT to approve Rezoning application 2824-RZ and Subdivision 7232 with amended conditions; and staff is DIRECTED to prepare the appropriate documentation for Board consideration on the March 27 , 1990 Determination Calendar. Supervisor Torlakson requested also that staff provide in advance copies of the final documentation to those who spoke. i hereby certify that this is a titre and correct cow►of Orig.
