SPECIFIC REQUEST(P) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Approve Rezoning Application 2838-RZ, GDL Construction &
Development, Inc. (Applicant) , Albert & Angelina Compaglia,
(Owners) , to rezone 2.12 acres from General Agricultural
District (A-2) to Single Family Residential District (R-6) , as
recommended by the County Planning Commission.
2. Adopt the County Planning Commission's findings as set forth in
its Resolution No. 54-1989 as the basis for your Board's decis-
ion.
3. Accept the environmental review documentation as being adequate.
4. Introduce the ordinance giving effect to the rezoning; waive
reading° and set date for adoption of same.

On January 30, 1990, the Board of Supervisors continued to this
date the hearing on the recommendation of the Contra Costa County
Planning Commission on a request by GDL Construction and Development,
Inca (applicant) and Albert and Angelina Compaglia (owners) requesting
approval to ':rezone 2. 12 acres of land from General Agricultural
District (A-2) to Single Family Residential (R-6) in the Martinez
area.
Supervisor Fanden advised the Board of Supervisors that she he would
be abstaining from this issue because of a conflict and passed the
gavel to Supervisor Powers to act as Chairman.
Mary Fleming, Community Development Department, presented the
staff report on the matter before the Board describing the site and
indicating that the rezoning to R-6 was considerably less than what
the General '''Plan for this area would allow. She commented on the
approval by the County Planning Commission and an approval of the
subdivision ,lto allow development of this site subject to the approval
of this rezoning. She commented on the conditions of approval that
were attached to the subdivision requiring road improvements along
Morello Avenue and, a request by the applicant for reimbursement of a
part of thefcost of constructing those improvements along Morello in
the event that the County adds the frontage of that property to the
Countywide Area of Benefit Road Improvement Program. She indicated
that Community Development and the Public works Department would
support the idea of their sharing the cost. Ms. Fleming presented the
staff recommendation to approve the rezoning, adopt the Planning
Commission findings, accept the environmental review documentation as
being adequate, introduce the ordinance and set the date for adoption
of same.

The public hearing was opened and no one appearing in opposition,
the public hearing was closed.
Supervisor McPeak moved to approve the staff recommendation.

Supervisor Schroder clarified that the motion also included the
reimbursement if the Area of Benefit is formed.

IT IS BY THE BOARD ORDERED that recommendations 1, 2, 3 and 4 are
APPROVED; and as in recommendation 4, Ordinance No. 90-12 is
INTRODUCED, ',reading waived and February 13, 1990 is set for adoption
of same. 1�
