Board of Supervisors FROM: INTERNAL,OPERATIONS COMMITTEE ®� s DATE: July 10, 1989 sTA,couKrf'; SUBJECT: IMPLEMENTATION PROCESS FOR MITIGATING IMPACTS OF WASTE DIVERSION Specific Request(s) or Recommendations(s) & Background & Justification RECOMMENDATIONS: 1. Request County Counsel to draft a proposed process for mitigating impacts of waste diversion which includes the following points: A. Whenever a community believes that there is a possibility or likelihood that there will be a substantial and long-lasting diversion of waste, or anytime thereafter, the host community should initially provide notification to the permitting jurisdiction. B. The host community should then either discuss the matter of diversion with the company which is doing the hauling or may contact the County and request that the County intervene and mediate the mitigation among those agencies which will benefit from the diversion and the host community. C. Any mitigation which is agreed on should be directly related to actual impacts on the host community, not for the purpose of providing a source of revenue unrelated to any actual impacts. D. If the communities which are benefitted from the diversion are unable to reach agreement with the host community on an appropriate mitigation, the matter should be referred to the Solid Waste Commission, which should be asked to review and provide their comments and recommendations to the Board of Supervisors. The County Counsel should consider at what level the final decision should be made on what an appropriate mitigation is and provide our Committee with their comments when the proposed process is returned to our Committee. 2. Request the County Counsel to report this matter back to our Committee on July 24, 1989 at 10:15 A.M. BACKGROUND: OnApril 11, 1989 the Board of Supervisors referred to our Committee a request from the Solid Waste Commission that the Board of Supervisors develop a process for implementing the policy statement which was included in the February, 1989 County Solid Waste Management Plan indicating that communities benefitting from waste diversion should fairly compensate impacted communities for adverse impacts caused by the waste diversion. On July 10, 1989 our Committee met with staff from the County Counsel's Office and reviewed a draft process. Our Committee feels that the Board of Supervisors needs a more structured process than was initially suggested by County Counsel in order to insure that the Board of Supervisors maintains an appropriate level of control over the decision as to what level of mitigation is appropriate in cases where the communities are unable to agree among themselves. We are,therefore, suggesting the outlines of a process as we have recommended it above. We hope to bring a final process to the Board following our July 24, 1989 meeting. - 2 -
