MICHAEL WALFORD, CHIEF ENGINEER DATE: JULY 18, 1989 SUBJECT: APPROVE LETTER OF INTENT TO ENTER INTO A JOINT EXERCISE POWERS AGREEMENT BETWEEN THE FLOOD CONTROL DISTRICT AND THE CITY OF BRENTWOOD. Specific Requests) or Recommendation(s) & Background & Justification I. RECOMMENDATION APPROVE the Flood Control District's intent to execute a Joint Exercise of Powers Agreement with the City of Brentwood for the installation of a portion of the Line A outfall pipe line in Drainage Area 52C, and AUTHORIZE the Chief Engineer to transmit a letter of intent to the City Council of the City of Brentwood. II. FINANCIAL IMPACT The estimated project cost is $300, 000. Drainage Area 52C would fund approximately $25, 000, the City of Brentwood $50, 000, and the Flood Control District's Revolving Fund $225, 000. The City of Brentwood ' and the District's contribution would be repaid by Drainage Area 52C as drainage fees are collected. III. REASONS FOR RECOMMENDATION/BACKGROUND The proposed joint project would benefit the City of Brentwood and the Flood Control District. The City is in the process of constructing a waste water treatment plant in the project area. Part of this work includes construction of a storm drain for the plant. The joint project would eliminate the need for this storm drain. The District would have approximately 2, 000 linear feet of 30 inch pipe installed within undisputed and accessible right of way. CONSEQUENCES OF NEGATIVE ACTION I If the proposed project cannot be constructed simultaneously with the construction of the waste water treatment plant, the cost to install the pipe line would increase substantially due to removal of pavement and other improvements. Also, the City of Brentwood would have expended approximately $50, 000 for an internal drainage pipe no longer needed when the District's project is constructed. NCW:BO:dmw DA52C.JPA Orig.
