THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA

SUBJECT: Resolution confirming report, ordering improvement and
levying first annual assessment for Kensington Area -
Zone 21 of the County Landscaping and Lighting District
AD 1979-3 (LL-2) . W.O. 6X5441
The Board of Supervisors of Contra Costa County RESOLVES
that:
This Board has taken a series of actions preliminary to ordering
the improvement in County Landscaping District AD 1979-3 (LL-2)
Zone 21, and now makes the following findings and orders:
1. The Board adopted its Resolution Initiating Proceedings for
the improvement described therein under the Landscaping and
Lighting Act of 1972, and directed J. Michael Walford,
Public Works Director, as the Engineer of Work for the
assessment district, to prepare the report required by
Section 22565, and following, of the Streets and highways
code.
The improvement is generally described as follows:
Maintain and service the landscaping improvements along
Arlington Avenue and at the Colusa Traffic Circle and where
funds are available, install public landscaping. Pathway
facilities are to be maintained and improved, as directed,
on a fiscal year by fiscal year basis.
2. The Engineer of Work filed the report as directed, and the
Board adopted its Resolution of Intention calling a hearing
on the report as required by Section 22587 of the Streets
and Highways Code. Notice of the hearing was given by
publication and by mailing to affected property owners, all
according to the Landscaping and Lighting Act of 1972 .
Affidavits of publication and mailing are on file with the
Clerk of the Board.
3. At the time and place for which notice was given, the Board
conducted a public hearing and gave every interested person
an opportunity to object to the proposed improvement, the
extent of the assessment district, or the proposed
assessment.
4. The Board FINDS that written protests against the proposed
improvement have not been made by owners representing more
than one-half of the area of the land to be assessed for the
improvement.
5. This project is exempt from CEQA. The Board hereby CONCURS
in the determination that the project is categorically
exempt and will not have a significant effect on the
environment, and hereby DIRECTS the Director of Community
Development to file the Notice of Exemption with the County
Clerk.

6. The Board APPROVES the Engineer's Report and each component
part of it, including each exhibit incorporated by reference
in the report.
7. The Board hereby APPROVES the annexation of the Kensington
Area - Zone 21 to the County Landscaping and Lighting
District AD 1979-3 (LL-2) .
S. The Board FINDS that the Engineer of Work, in the engineer's
Report has fairly and properly apportioned the cost of the
improvement to each parcel of land in the assessment
district in proportion to the estimated benefits to be
received by each parcel, respectively, from the improvement.
The Board hereby CONFIRMS and LEVIES each individual
assessment as stated in the Engineer's Report.
9. The Board ORDERS the improvement described in paragraph 1
and as detailed in the Engineer's Report.
