SUBJECT: STATUS OF LEGISLATION TO REORGANIZE THE METROPOLITAN
TRANSPORTATION COMMISSION - AB 1611 (Eastin)
Specific Request(s) or Recommendations(s) & Background & Justification
RECOMMENDATION:
Determine what position the Board of Supervisors wishes to take on AB 1611 (Eastin).
BACKGROUND:
At your meeting on June 27, 1989 it was noted that the Board's official position on AB 1611 (Eastin) is one of
opposition. The Board of Supervisors asked that this matter be placed on the agenda for discussion again on July
11, 1989.
AB 1611 was last amended June 26, 1989. The bill currently would do the following:
1. It eliminates the non-voting seats for the United States Department of Transportation and the United States
Department of Housing & Urban Development as was proposed in the original version of the bill.
2. It restores the seat for the San Francisco Bay Conservation and Development Commission which had been
eliminated in the original version of the bill.
3. It restores the seat for the Association of Bay Area Governments to voting status which had been proposed to
be made non-voting in the original version of the bill.
4. It retains the non-voting seat for the Bay Area Air Quality Management District which had been proposed for
addition in the original version of the bill.
5. It adds a third seat each for Alameda and Santa Clara Counties, as was proposed in the original version of the
bill.

ACCEPTED report on the status of proposed legislation AB 1611; and REFERRED the matter
to the Transportation Committee to work with the Contra Costa County Transportation
Authority to monitor the bill and come back to the Board with a recommended position.

6. It retains two seats each for San Francisco, Contra Costa and San Mateo Counties anis presently the case.
7. It retains one seat each for Marin, Napa, Solano and Sonoma Counties, as is presently the case.
8. It retains the currently authorized non-voting seat appointed by the Secretary for Business and Transportation.
As a result, the composition of MTC, according to AB 1611,as amended May 16, 1989, would be as follows:

9. It specifies that voting membership on committees of the Commission is reserved for individuals who would
also be able to vote on items before the full Commission.
10. It specifies that counties shall have membership on the Commission based on population as follows:

800,001 to 1,200,000 3
1,200,001 to 1,600,000 4
1,600,001 or more 5
11. It specifies that the Commission shall be reconstituted as noted above as of January 1, 1991.
12. It specifies that the number of seats allocated to each county will be redetermined following the 1990 census
and after each subsequent decennial census.
13. It specifies that a county which can present a letter from the State Department of Finance indicating that it has
exceeded the next population threshold may petition the Commission for an additional seat and that upon receipt
of such proof the Commission shall grant the county an additional seat.
In view of this last provision, there is a good chance that Contra Costa County will be in a position to petition for
another seat within a couple of years, as soon as the State Department of Finance certifies that our population has
exceeded 800,000.
AB 1611 has failed to obtain enough votes on the Assembly floor to pass and in unlikely to receive further
consideration this year.
