HomeMy WebLinkAboutMINUTES - 07111989 - 1.34 100034 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA , AS THE GOVERNING BODY OF THE CONTRA COSTA COUNTY FLOOD CONTROL AND WATER CONSERVATION DISTRICT Adopted this Resolution on July 11, 1989, by the following vote: AYES: Supervisors Powers , Fanden, Schroder , McPeak & Torlakson NOES: None ABSENT: None ABSTAIN: None Resolution-No . 8.9/454 _.__ (West's Water Code App. Ch. 63, Sec. 3 and 11) SUBJECT: Notification of Hearing to Consider the Establishment of Flood Control District Zone 6A, Project No. 7505- 6F8198, E1 Sobrante/Richmond/San Pablo Area. The Board of Supervisors of Contra Costa County, as the Governing Body of the Contra Costa County Flood Control and Water Conservation District, RESOLVES THAT: The Contra Costa County Flood Control and Water Conservation District Act, hereinafter referred to as Act, provides authority for said Governing Body to establish flood control district zones; and The Board has before it for consideration the proposed establishment of Flood Control District Zone 6A consisting of the real property described in Exhibit "A, " attached hereto and incorporated herein by reference; and The Board also has before it the Engineer's Report and the Drainage Plan, entitled, "Flood Control District Zone 6A Boundary Map and Limits of Drainage Facilities Maintenance, " dated May 1989, proposed to. be adopted for Flood Control District Zone 6A. Said documents, which show the general location of said Flood Control District Zone, are on file with, and may be examined at, the office of the Clerk of the Board of Supervisors, Administration Building, Martinez, California; and It is proposed that Flood Control District Zone 6A be established to provide an entity under which Special District Augmentation Funds for the maintenance of facilities on major and secondary channels with the Zone can be allocated; and At 11: 00 a.m. on August 22, 1989, in the Chambers of the Board of Supervisors , Administration Building, Martinez, California, this Board will conduct a public hearing on the Proposed establishment of said Flood Control District Zone 6A. At said hearing, this Board will consider and act upon the adequacy of the environmental review and will hear and pass upon any and all written or oral objections to the establishment of the Flood Control District Zone 6A. Upon conclusion of the hearing, the Board may abandon the proposed Flood Control District Zone, or proceed with the same. The Clerk of this Board is DIRECTED to publish a Notice of the Hearing, , pursuant to Government Code Section 6066, once a week for two (2) successive weeks prior to the hearing in the "West County Times, " a newspaper of generale circulation, circulated in the area proposed to be formed into said Flood Control District Zone. Publication shall be completed at least RESOLUTION NO. 89/ 454 seven (7) days before said hearing, and said notice shall be given for a period ,of not less than twenty (20) days. The exterior boundaries of said Flood Control District Zone include lands within the sphere of influence of the cities of Richmond and San Pablo. The Clerk of this Board is DIRECTED to forward to the governing body of said Cities a copy of this Resolution at least twenty (20) days before the above noted hearing. The Clerk of this Board is further DIRECTED to mail a copy of the Notice of Public Hearing to any interested party who has filed a written request for mailed notice with the Clerk of the Board or with the District, as provided by Government Code Sections 54986 (a) and 54992 (a) . Said mailing shall be performed at least fourteen (14) days prior to the hearing. All that property situated in Contra Costa County, California, described as follows: All of Contra Costa County Flood Control and Water Conservation District Drainage Area 73 adopted May 18, 1982 by Resolution No. 82/555 of the Board of Supervisors of Contra Costa County, California. And the northerly portion of Assessment District No. 1982-2 San Pablo Creek Improvements filed August 6, 1982 in Book 21 of Maps of Assessment Districts at page 9 in the office of Contra Costa County Recorder. Said northerly portion being all of Assessment District No. 1982-2 lying northerly of Wildcat Creek Watershed Zone 7 adopted December 18, 1962 by Resolution No. 62-161 of the Commission of the Contra Costa County Flood Control and Water Conservation District.
