Eating Establishments SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION: That the Contra Costa County Board of Supervisors adopt a support position on SB 1418 (Boatwright) which provides, among other things, that restaurants may have a separate smoking section, but only if it is enclosed, has its own air ventilation system, and comprises no more than 50% of the restaurant seating. BACKGROUND: The inhalation of second hand smoke, commonly known as involuntary or passive smoking, can cause disease in healthy nonsmokers. According to the Surgeon General 's recent report, "The Health Consequences of Involuntary Smoking" , passive smoking can cause respiratory, lung, and auditory problems in children, as well as lung cancer, other cancer, and heart disease in adults. SB 1418 would not preempt the implementation and enforcement of any local ordinance enacted .prior to or after January 1, 1990, which contains provisions more stringent than those contained in the bill . In addition, the prohibition against smoking would not apply to separate banquet rooms used for a private party, nor to cocktail lounges or bars not located in an eating establishment in which the service of food is incidental to the service of alcoholic beverages.
