TAKING AWAY DRIVERS LICENSES OF
SUBJECT: CONVICTED DRUG DEALERS (SECOND CONVICTION)
SPECIFIC REQU.EST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Refer to the I .O. Committee for study and possible
legislative action, the right of the courts to revoke the
drivers license of anyone convicted of selling drugs for a
second time.
This condition of probation could become a real hammer for
law enforcement officials. If the offender violates it he
could be immediately returned to jail to serve out his time.
BACKGROUND:
It' s been observed that most young dealers go for the flashy
clothes and cars - status symbols reflecting wealth and
success . It would be a real blow to their egos and loss of
status among their peers if they were denied the privilege
of driving a car.
This type of legislation could constitute a tremendous
breakthrough in dealing with repeat offenders. Dealing
drugs has always meant easy money. Therefore, the temptation
will always remain. Perhaps when they have something to
lose that' s important to them they' ll reconsider selling
drugs for a living.
In a letter to Senator Dan Boatwright dated March 24, 1989,
I solicited his comments on this matter. He in turn
responded, suggesting a future meeting to see if something
can be worked up later in the legislative session.
