Recommended Action: A. APPROVE Amendment to Right of Way Contract with Antioch Estates, LTD. . and AUTHORIZE the Chief Engineer to sign same on behalf of the District B. AUTHORIZE the Board Chair to sign Quitclaim Deed and Grant of Easement to Antioch Estates, LTD. on behalf of the District. C. ACCEPT Grant Deed from Antioch Estates, LTD. and DIRECT the Real Property Division to record same. II. Financial Impact: The District is to receive $20, 000 from Antioch s ates, LTD. Reasons for Recommendations and Background: On December 30, 1986, the District acquired approximately 12 .5 acres of land on East Antioch Creek, for the Trembath Detention Basin. As successor in interest to the original grantor, Antioch Estates, LTD. has requested that the District now convey an access easement to them over a specific route that could not be ascertained at the time of the previous conveyance. It was also recently discovered that the record boundaries of the parcel conveyed to the District do not match ground conditions. In order to clear up the boundary inconsistency, and provide the access to a presently landlocked parcel, the District will be receiving a new deed to the Trembath Basin and conveying an access easement to the current owner. Antioch Estates, LTD. will return to the District $20, 000 which represents the current value of the easement which could not be deducted from the original purchase price owing to its uncertainty as to location and size. IV. Consequences of Negative Action: The legal description of Trembath Basin will be at odds with actual ground conditions; a landlocked parcel will be created requiring further attention to providing access; the District will not receive $20, 000.
