SUBJECT: Amendment to Western Contra Costa County Transit Authority
Agreement
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) a BACKGf20UND AND JUSTIFICATION
RECOMMENDATION:
Approve the seventh amendment to the Western Contra Costa County
Transit Authority Agreement between the cities of Hercules, Pinole
and the County, and authorize the' Chair to execute the same.
FINANCIAL IMPACT:
None.
REASONS FOR RECOMMENDATIONS/BACKGROUND:
WestCAT, the transit operator for the cities of Hercules, Pinole, and
the unincorporated communities of- western Contra Costa County, has
requested an amendment to their Jbint Powers Agreement authorizing
the Authority to acquire and holdlreal property, and exercise eminent
domain, and revise procedures for the disposition of assets. The
WestCAT Board has requested this amendment in order to proceed with
its project to build a maintenance yard for bus operations.
This amendment has been reviewed by County Counsel and Community
Development. The amendment would allow WestCAT to proceed with their
project. The amendment has been approved by the cities of Hercules
and Pinole.
CONSEQUENCES OF NEGATIVE ACTION:
Failure to approve the amendment would prevent WestCAT from
proceeding with construction of their bus facility.

year capital improvement program for infrastructure to serve this
development. It also contains the traffic level of service standards
included in Measure C. The growth management element will become
effective upon adoption of the County General Plan in late 1989.
In 1990 , the CCTC will develop guidelines that the cities and County
can use for compliance with the growth management program of Measure
C. The County will need to review its growth management element for
compliance with these guidelines when they become available. The
tasks, budget, and timetable to meet compliance with the guidelines
are attached to the Resolution of Intent. These tasks, budget, and
timetable will be used to develop a compliance plan for Measure C
_ once more information is available on the CCTC guidelines.
The cost to comply with the Measure C program will be funded through
the sales tax revenues the County receives from the CCTC. Current
discussions by the CCTC indicate that the County will receive an
annual allocation of up to $50 , 000 to comply with Measure C following
adoption of the Resolution of Intent and the traffic level of service
standards. Additional allocations or advances may be made with the
submittal of a compliance plan and "special finding" request to the
CCTC. Any funds allocated to the County for developing the growth
management program must be returned to the CCTC, with interest,
should the Board of Supervisors not adopt and implement the growth
management program required by Measure C.
If found in compliance with the growth management program of Measure
C, the County is anticipated to receive an estimated $1. 2 million
annually ( 1989 dollars) .
CONSEQUENCES OF NEGATIVE ACTION:
The County will not receive any sales tax revenues from Measure C
unless it approves the Resolution of Intent and develops and
implements a growth management program as required by the CCTC. The
County would receive an estimated $1. 2 million annually ( 1989
dollars) for street and road purposes from this revenue source.
