Accept the Environmental Documentation' prepared for this project, as being complete and adequate. 2. Deny the appeal of Mr. William F. Young, which upholds the Zoning Administrator and Board of Appeals Denial of LUP 2084-88 . 3. Adopt the County Board of Appeals findings as set forth in Resolution No. 24-1989 as the basis for your Board' s decision. BACKGROUND This request for a 2nd residential unit was submitted by Mr. William F. Young on August 5, 1988. The County Zoning Adminis- trator after review and consideration denied the request on December 19, 1988. Mr. Young appealed that decision to the Planning Commission sitting as the Board of Appeals. The Board of Appeals upheld the Zoning Administrator decision on February 28, 1989 by denying Mr. Young's appeal. Following that denial, on March 9, 1989 Mr. Young appealed the Board of Appeal decision to the County Board of Supervisors for a hearing and deter- mination. Young and M. Nell Young (appellants) from the decision of the Contra Costa County Planning Commission sitting as the Board of Appeals upholding the decision of the Zoning Administrator on the request by William F. Young (applicant and owner) to establish a second residential unit (LUP 2084-88) in the El Sobrante: area. Karl Wandry, Community Development Department, presented a summary of previous actions on the Land Use Permit 2084-88 application, commenting that subsequent to the May 23, 1989 meeting continuing the hearing to this date that they have met with the applicant and addressed the concerns that everyone had. He advised that the applicant has submitted a revised site plan before the Board today that is acceptable to staff and meets the conditions or problems that were addressed with staff. He commented that the staff recommendation was for approval of the land use permit with the original conditions. William F. Young, 1125 Kelvin Road, E1 Sobrante, commented that agreement had been reached and he had no further problems. The public hearing was closed. Supervisor Fanden moved to approve .the staff recommendation as was presented with the agreements that were reached by both parties. Development shall be as shown on revised plans submitted on June 20, 1989. 2. The second residential unit must be rented or leased and provide complete independent living facilities for one or more persons. 3. The second unit must consist of permanent provisions for food preparation, eating, sleeping, water, and sanitation. 4. The second unit must remain clearly subordinate in size, appearance, and location of the existing principal residence. 5. The second unit may not exceed 600 sq. ft. or contain more than two bedrooms or one bathroom. 6. The second unit and the principal residences exterior finish, shall be of similar style and design. 7. The County Building Inspection Department requirement for a land survey and their regulations together with all other County regulations must be satisfied. 8. If a separate sewage or water system are proposed, they must gain West County Sanitary District and E.B.M.U.D. approval . 9. Three off-street parking spaces shall be provided on the site. Location of the parking .spaces must be shown on plans for building permit. 10. Proof of recordation of the following disclosure or deed restrictions must be submitted to the Community Development Department prior to the issuance of a building permit: "You are purchasing a property with a permit for a residential second unit. This permit carries with it certain conditions that must be met by the owner of the property. The permit is available from the current owner or from the Contra Costa County Community Development Department." 11. Comply with drainage, road improvement, traffic and utility requirements as follows: The applicant shall conform to the requirements of Division 914 (Drainage) of the Subdivision Ordinance by: a. Conveying all storm waters entering or originating on the subject property to an existing adequate storm drainage facility. An exception is permitted from that provided that the applicant: Maintains the existing drainage pattern and does not dispose of concentrated storm waters onto adjacent property, and MEN N A Limits the size of the second residence to a maximum of 1000 square feet total ground coverage, and does not appreciably increase the area of "permanent" impervious surfaces (driveways, sidewalks, patios, etc. ) that may result from the placing of the second residence on this property. 12. The applicant shall pay $1,749 Bridge/Thoroughfare Fee for the Richmond/ E1 Sobrante Area of Benefit. 13. The applicant shall obtain an encroachment permit from the Public Works Department, for any construction of driveways or other improvements within the right of way of Kelvin Road. 14. The applicant shall install all new utility distribution services under- ground. 15. If construction of drainage improvements is required, the applicant shall : a. Furnish proof to the Public Works Department, of the acquisition of all necessary rights of entry, permits and/or easements for the construction of off-site, temporary or permanent, road and drainage improvements. b. Submit improvement plans prepared by a civil engineer to the Public Works Department, for review, pay the inspection and plan review fees. The plans shall be submitted prior to the issuance of any building permit. If final inspection is requested prior to construction of improvements, the applicant shall execute a road improvement agreement with Contra Costa County and post bonds required by the agreement.
