THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
DATE; June 20, 1989 MATTER OF RECORD
SUBJECT: MS 37-88, Oakmont Cemetery
Dan Curtin, attorney, McCutchen, Doyle, Brown & Enersen, P.O.
Box V, Walnut Creek 94596-1270, appeared before the Board this day
and inquired as to the delays incurred in scheduling the findings
for MS 37-88 (Oakmont Cemetery) for Board action. He noted that on
April 25, 1989 the Board granted the appeal of DK Associates
(applicant) and M.B. Lines (owner) from decision of the County
Planning Commission with it being understood that appropriate
findings were to be prepared and presented to the Board at a later
date. He also noted that the request of several property owners
for reconsideration was denied on May 9, 1989 . Mr. Curtin advised
that the findings have been prepared and requested that they be
agendaed for Board action on June 27 , 1989.
Supervisor Schroder commented on the controversy pertinent to
the Development Plan which, he stated, is not an issue before the
Board at this time but may be at a later date. He expressed an
interest in having the findings presented for Board review and
action as soon as possible. He noted that his approval for MS
37-88 was for a two-lot minor subdivision and was not to be con-
strued to include approval for the Development Plan.
Supervisor Fanden referred to pending court action relative to
the removal of certain cemetery land out of that land use designa-
tion. She expressed her preference in having the findings pre-
sented to the Board following the court hearing on this matter.
Supervisors Schroder, McPeak, and Torlakson expressed support
for .listing the findings for MS 37-88 on the June 27, 1989 Agenda.
Supervisors Powers and Fanden did not.
The Chairman instructed the Clerk to agenda this matter for
determination on June 27, 1989. Staff was requested to so notify
persons who have testified on this matter.
