Adopt a position on the Port of Oakland Dredge Disposal Program. FINANCIAL IMPACT None. BACKGROUND The Port of Oakland is proposing to dispose of approximately 440 ,000 cubic yards of dredge sediments on the landward side of levees on Twitchell Island and Lower Jones Tract in the Delta. A draft supplemental Environmental Impact Report (EIR) was released, and testing of dredge samples was performed in February, 1989. Contra Costa County comments regarding this project were submitted in a letter of March 11, 1989, addressing the need for additional testing, provision of adequate time to review new data and the need for more detail regarding mitigation, monitoring and contingency plans.. In addition, a letter wassent on May 23 , 1989 to the Port from the Board of Supervisors requesting a workshop be arranged to discuss results of additional tests, and earliest possible receipt of new data prior to Port certification of the final supplemental EIR. CLERK OF THE BOARD OF SUPERVISORS AND COUNTY ADMINISTRATOR M382/7-83 BY e- DEPUTY The Port responded that an interagency workshop would not be possible due to time constraints incurred in integrating recent test results into the final EIR, but indicated a willingness to meet on an individual basis. County staff received the preliminary draft final EIR on June 2 , 1989 , and met with the Port to review this document on June 5 , 1989 . The Port expects certification of this EIR and subsequent legal findings on this project to take place on June 20, 1989, and will submit legal findings on this project prior to this time. The preliminary final EIR addresses the comments submitted by the Board of Supervisors on March 21, 1989, containing results of additional testing as well as Monitoring and Contingency Plans. At their meeting of June 5 , 1989, the Water Committee indicated they wished to insure that the Findings document adequately addresses the implementation of the Monitoring and Contingency Plans before consideration of a position on this project by the Board of Supervisors. If adequate mechanisms are contained in the Findings document to assure adequate monitoring and emergency plans, the Water Committee would recommend a position endorsing this project. Additional input from the Contra Costa Water District and Congressman Miller is also expected by June 20 , 1989 . jli8 :por.brd 2.
