SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION
Take the following positions, as Governing Board of the Contra
Costa Water Agency, on the legislation below:
SB 1500 (Hart) -- Coastal Resources; Ocean, Estuarine waters and
wetlands
( 3/10/89) -- Support
SCA 24 (Nielsen) -- Water Resources Development
( 3/8/89) -- Support
SCA 28 (Doolittle) -- water Resources Development
( 3/13/89) -- Support.
FINANCIAL IMPACTS
None.
REASONS FOR RECOMMENDATION/BACKGROUND
At their meeting on June 5, 1989, the Board of Supervisors' Water
Committee considered each of the proposed legislative bills and
examined the rationale that justified the above-stated positions
for consistency with the County' s established water policy. A
summary of the bills and rationale for the County positions is on
file with the Community Development Department. ,

POSITIONS OF THE CONTRA COSTA COUNTY WATER AGENCY
ON SELECTED 1989 WATER LEGISLATION
(FOR BOARD OF SUPERVISORS' CONSIDERATION NNE 13, 1989)
SB 1500 - Hart - Coastal Resources; Ocean, Estuarine Waters, and Wetlands
(3110/89)
Summary:
This bill prohibits new development that could cause destruction within or
adjacent to wetland areas, creates the California Coastal Sanctuary, and
prohibits State agencies from obtaining new oil and gas leases within this
coastal zone. Oil and gas leases would be allowed under specified conditions.
This legislation further stipulates that grounds for appeal to the California
Coastal Commission include adverse impacts of development in environmentally
sensitive habitat or wetland.
This bill includes waste discharge requirements which are listed as follows:
° The State Regional Water Quality Control Board (State Board) would be
required to review and revise the 1974 Water Quality Control Policy for
bays and estuaries to include numerical sediment quality standards.
° Require the State Board to adopt sediment control objectives and submit a
toxic hot spots cleanup plan to the Legislature by January 1, 1993.
° Require holders of NPDES waste discharge permits to perform biomonitoring.
° Require the State Board to revise NPDES permits to conform with water and
sediment objectives and waste load calculations.
° Require the State Board to revoke secondary sewage treatment waivers by
January 1, 2000.
° Authorize publicly-owned treatment plants to establish a fee system to
recuperate increased costs of sewage treatment.

Rationale:
This legislation provides methods to implement measures consistent with County
policy regarding Bay-Delta protection, and preservation of wetland areas. .

SCA 24 - Nielsen - Water Resources Development
Summary:
Any changes or deletions to provisions of the Water Code regarding the County of
Origin Statute, the Watershed Protection Statute and the Delta Protection Act
will require passage of such a statute in each house of the Legislature by a 2/3
vote.

Rationale:
This legislation is consistent with County policy regarding protection of Areas
of Origin and Bay-Delta water resources.
SCA 28 - Doolittle - Water Resources Development
Summary:
Any changes or deletions to provisions of the Water Code regarding the County of
Origin Statute, the Watershed Protection Statute and the Delta Protection Act
will require passage of such a statute in each house of the Legislature by a 2/3
vote.
Recommended Position:
Support.
Rationale:
This 'legislation is consistent with County policy regarding protection of Areas
of Origin and Bay-Delta water resources.
NOTE: Tim Farley, of Assemblyman Bob Campbell's office, communicated with the
Elections and Reapportionment Committee regarding the ability to referend
legislation, requiring a 2%3 vote as contained in SCA 24 and SCA 28. The
ability to referend exists with respect to these bills. As stated in
Article 2, Section 9 of the State Constitution, all legislation may be
referended except: 1) urgency bills, 2) budget items, and 3) upcoming
election items.
