SUBJECT: Hearing on Rezoning Application #2821-RZ, filed by Danville Land and
Development (Applicants) and Gerald R. Hertz, et al (Owners) , for
approval to rezone 1.38 acres of land located on the south side of
Willow Pass Road, on both sides of Marin Avenue, in the the West
Pittsburg area, from Retail Business District (R-B) and Multiple
Family Residential District (M-29) to Retail Business (R-B) . (APN
097-301-011 and 012; 097-302-025 and 026) .
SPECIFIC REQUEST(S) OR RECOPIIE&NIDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Accept the environmental documentation prepared for this
project as being adequate.
2. Approve Rezoning Application #2821-RZ as recommended by the
East County Regional Planning Commission.
3. Adopt the East County Regional Planning Commission' s findings
as set forth in Resolution No. 19-1989 as the determination
for these actions.
4. Introduce the ordinance giving effect to the aforesaid
rezoning, waive reading and set forth date for adoption of
same.

This being the time heretofore noticed by the Clerk of the Board
of Supervisors for hearing on the recommendation of the East County
Regional Planning Commission on the request by Danville Land and
Development (applicant) and Gerald R. Hertz, et al (owners) to rezone
1. 38 acres of land from Retail Business District (R-B) and Multiple
Family Residential (M-29) to Retail Business (R-B) ( 2821-RZ) in the
West Pittsburg area.
Jean Mesick, Community Development Department, presented the
staff report on the above request and the staff recommendation for
approval.
The public hearing was opened and no one appearing in opposition,
the public hearing was closed.
On recommendation of Supervisor Torlakson, IT IS BY THE BOARD
ORDERED that recommendations 1, 2, 3, and 4 are APPROVED; and as in
recommendation 4, Ordinance No. 89-38 is INTRODUCED, reading waived,
and June 20, 1989 is set for adoption of same.
