SUBJECT: REVIEW VIABILITY OF BAY POINTE LANDFILL SITE
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDED ACTION: Direct the Community Development
Department and County Counsel to review the viability of the proposed
Bay Pointe landfill site in light of the recent purchase by A. D.
Seeno Construction Company of a major portion of the land. Request a
staff report for Board consideration as soon as possible.
BACKGROUND INFORMATION: I have been informed that A.D.
Construction Company has purchased the Faria parcels which formed the
major land area of the Bay Pointe Sanitary Landfill project.
According to a company representative, the company will not pursue a
landfill development on the site. With the sale of the Faria
properties, it seems to me that the landfill project initiated by
California Land Research in 1986 is no longer viable, if indeed it has
been viabloe since last November when the U.S. Navy announced that it
would not allow a sanitary landfill on the Federal Explosives Safety
Easement which covers two-thirds of the proposed landfill area.
I do not believe the Community Development Department ever
received a complete Comprehensive Project Description on the site, so
there is not even an application to be withdrawn. The Bay Pointe
Landfill, however, is one of five sites our Board included in the
proposed Solid Waste Management Plan and for which we initiated
General Plan Amendments . The Environmental Impact Report on the Solid
Waste Plan will go to the public hearing in only two weeks and the
plan amendments are to go to hearing in August. Many of my
constitutents are, naturally, extremely anxious about the proposal and
our staff, the Planning Commission, and our Board are going to have to
put in a lot of unnecessary time and energy over a dead proposal.
I realize we cannot change the Solid Waste Management Plan
and the Stipulated Judgment program with the California Waste
Management Board with a sweep of a hand, but I do think we can find
out what our options are and then pursue them on an informed basis.
Consequently, I propose that we refer this matter to the Community
Development and County Counsel, and have them report back as soon as
possible.
