HomeMy WebLinkAboutMINUTES - 05091989 - T.A T.A THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on May 9, 1989 , by the following vote: AYES: Supervisors Powers, Fanden, Schroder, McPeak, Torlakson NOES: None ABSENT: None ABSTAIN: None ------------------------------------------------------------------ ------------------------------------------------------------------ SUBJECT: Appointment of the County Clerk-Recorder In accordance with the instructions of the Board on April 18 , 1989, the County Administrator presented a report on the four finalists (Charles Bock, Robert Delevati, Gus Kramer, and Stephen Weir) for the position of County Clerk-Recorder. The County Administrator' s report responded to the Board' s request for a fingerprint criminal records check, presentation of economic disclosure statements, and other information to assist in the determination of the candidate most qualified for the position. Chairman Torlakson commented on the qualifications of the four finalists. He noted that Stephen Weir has had much budget experience in working with other government agencies, and therefore nominated Mr. Weir for the position. The nomination was seconded by Supervisor McPeak. Supervisor Schroder also spoke on the qualifications of all the finalists and stated that after having spent some time considering the candidates for this appointment, he advised of his preference to limit the selection between the two candidates (Robert Delevati or Charles Bock) currently working in the Clerk' s Office because of their experience and knowledge of the operation and management of the Clerk' s Office. Supervisor Fanden advised that her first choice for the Clerk- Recorder' s position would be Gus Kramer. She also commented on the other three finalists and stated that her second choice would be Robert Delevati. Supervisor Powers advised that he would support the nomination of Stephen Weir. Supervisor Schroder stated for the record that all four finalists were equally qualified for the position of Clerk-Recorder. However, he expressed the belief that those individuals currently working in the Department should have preference in the selection process for the posi- tion. He referred to a previous statement he had made, and of which the Board concurred, that the individual appointed should be by unanimous vote of the Board. Noting that Mr. Weir appears to have a majority vote of the Board, Supervisor Schroder advised that he would support Mr. Weir' s appointment. Supervisor Fanden advised that she would also vote for Stephen Weir. THEREFORE, IT IS BY THE BOARD ORDERED that Stephen L. Weir is APPOINTED County Clerk-Recorder at a monthly salary of $4,986 effective this day to fill the unexpired term of James R. Acknowledge receipt of the report of the County Administrator,in response to the Board's order of April 18, 1989, providing additional information on the candidates for County Clerk-Recorder and issues which will confront the new incumbent. 2. Determine what action the Board wishes to take in regard to appointing a new County Clerk-Recorder. BACKGROUND: As a result of the Board's interviews of the top eight candidates for the position of Clerk-Recorder, four finalists were chosen. The following actions have been taken in regard to those candidates: 1. A fingerprint criminal records check has been conducted on each of the four finalists by the State Department of Justice. All results are negative. Copies of the records are attached for the Board's information. All other information which has come to our attention has also been investigated. None of these investigations has resulted in any information which would preclude appointment of any of the finalists to the position of County Clerk- Recorder. 2. Economic disclosure statements have been requested from each candidate. Attached is the summary page from each of the four finalists' statements along with the detailed schedule where that form has been completed. 3. The issue of incompatible offices has been discussed with the County Counsel. County Counsel has indicated that Mr. Weir would have no legal conflict of interest in serving simultaneously on the Concord City Council and as County Clerk-Recorder. Each of the finalists was asked to indicate whether he would run for Clerk-Recorder in 1990 if he were not appointed now. Mr.Kramer indicates he will run. Mr. Delevati indicates he will not run. Mr. Bock indicates that whether he runs or not next year will depend on the extent to which he has confidence in the incumbent appointed by the Board. Mr.Weir indicates that under the provisions of Proposition 73 he is not yet prepared to declare whether or not he will run for the office. 5. We asked each of the candidates to comment on what challenges they felt the next Clerk-Recorder would face. The response from each candidate is attached. 6. We asked each candidate how much time he felt the Clerk-Recorder's Office would require. Each candidate indicated he expected to spend in excess of 50 hours a week on the job. 7. Each employee in the Clerk-Recorder's Office was given an opportunity to submit in writing,anonymously,their comments on what challenges would face the next Clerk-Recorder. Several themes emerged from the responses of the employees. These include the perception that the next Clerk-Recorder will face the following challenges: A. Managing a department with a substantially expanding workload in a time when there are insufficient resources to meet all of the legitimately identified needs in the department. B. Bringing three rather separate divisions together and melding them into a well-coordinated, unified department. C. Working to improve the morale in the office. D. Providing strong management direction to the department and reviewing the need for additional training of supervisory and management staff. E. Improving technical training in the office. F. Giving additional attention to the adequacy of the physical facilities in which staff are working. G. Reviewing the adequacy of the department's current automation systems and determining ways to meet additional needs to improve and upgrade data processing systems to increase productivity and efficiency. H. Addressing the concerns of employees regarding their physical safety. I. Reviewing workload concerns and determining how they can best be addressed. Meeting these challenges will demand the complete dedication and full-time commitment of whichever of the candidates is selected. Westman, • County Counsel Re: County Clerk's Office, City Council member On April 18, 1989, when Mr. Steven L. Weir was interviewed by the Board of Supervisors for possible appointment as County Clerk, he indicated that should he be appointed Clerk he intended to concurrently keep and serve out his current Concord City Council term. You have asked whether Mr. Weir's proposed concurrent serving out of his present city council term would for any legal reason' (e.g. , incompatibility of office) , bar his assumption of and remaining in the office of County Clerk during this period. In these circumstances, I do not know of any legal bar which would prevent Mr. Weir's assumption of the County Clerk's Office and remaining therein during the completion of his city council term. Whether assuming the Office of County Clerk would create any circumstance of incapatibility concerning the completion of his current city council term is a question vested in the involved city council for its administrative decision. (Govt.Code SS 36512 & 36812, also see 30 Ops . At Gen. 56, 59 & 41 Ops . Atty. Gen. 98, 100. ) Mr. Weir has provided to the Board of Supervisors the attached April 12, 1989 opinion of the Concord City Attorney that he may legally remain as a city council member should he assume the Office of County Clerk.
