May 9, 1989 Adopted this Order on . , by the following vote: AYES: Supervisors Powers, Fanden, Schroder, McPeak and Torlakson NOES: None ABSENT: None ABSTAIN: None SUBJECT: In the Matter of Heritage Woodland Designation (County File HT-1) in the E1 Sobrante Area RESOLUTION NO. S7 337 WHEREAS, on January 31, 1989 Tim Nash (Applicant) , filed an application under the Heritage Tree Designation Ordinance ( #HT-1) , for heritage woodland designation of all woodlands found in the main ridge, northward-facing slopes, two prominent hills and riparian areas of property described as consisting of approximately 100 acres spread between Assessor's Parcel Nos. 433-110-014 (Radach/Hill) and #433-110-020 and #433-110-021 (Dame Construction Co. ) , and further described as being located in the southeast quadrant of the intersection of Castro Ranch Road and Hillside Drive, in the El Sobrante area; and WHEREAS, in connection with the applicant's request, a determination was made that the request is categorically exempt from the California Environmental Quality Act (Class 8) ; and WHEREAS, after notice was lawfully given, a public hearing was scheduled before the County Planning Commission on Tuesday, March 14, 1989, whereat all persons interested therein might appear and be heard; and WHEREAS, on Tuesday, March 14, 1989 the County Planning Commission conducted a noticed public hearing and CONTINUED the public hearing to the meeting of March 28, 1989, in order that the Commission schedule a field trip to the site; and WHEREAS, on Friday March 24, 1989 a field trip was undertaken by members of the County Planning Commission to the site in E1 Sobrante of the proposed Heritage Woodland designation; and . WHEREAS, on Tuesday, March 28, 1989 the County Planning Commission having fully reviewed, considered and evaluated all the testimony and evidence submitted in this matter, recommended to the Board of Supervisors of the County of Contra Costa,-- State of California, that the request of Tim Nash (Applicant) , for establishment of the above described Heritage Woodland designation ( #HT-1) be APPROVED; and WHEREAS, after notice was lawfully given, a public hearing was scheduled before the Board on April 18, 1989, whereat all persons interested therein might appear and be heard; and WHEREAS, on April 18, 1989 the Board conducted a noticed public hearing and DECLARED ITS INTENT to approve the Heritage Woodland nomination; and WHEREAS, on May 2, 1989 the Board further accepted Exhibit "A" (attached) as the demarcation of the nominated woodland, pending more precise mapping by Community Development Department staff ; and 89/337 2. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of the County of Contra Costa, State of California hereby registers the woodland delineated above as a Heritage Woodland under the provisions and protections of County Ordinance No. 88-83; and BE IT FURTHER RESOLVED that the reasons for this registration are as follows: 1. Among the features that contribute to the attractiveness and liveability of the County are its heritage trees growing as single specimens, in clusters or in woodland situations. These trees have significant psychological and tangible benefits for both residents and visitors to the County. 2. Heritage trees contribute to the visual framework of the County by providing scale, color, silhouette and mass. Heritage trees contribute to the climate of the County by providing shade, moisture and wind control. Heritage trees contribute to the protection of other natural resources by providing erosion control for the soil, oxygen for the air, replenishment of groundwater and habitat for wildlife. Heritage trees contribute to the economy of the County by sustaining property values and reducing the cost of drainage systems for surface water. Heritage trees provide landmarks of the County' s history and a critical element of nature in the midst of urban settlement. BE IT FURTHER RESOLVED that the Board of Supervisors finds that the heritage woodland request conforms substantially with the goals of the adopted County Ordinance 88-83 : Urgency Ordinance on Heritage Tree Preservation District.
