BACKGROUND:
Construction at 291 Arlington Ave. remains stopped due to unresolved questions on the
structural adequacy of an existing retaining wall.

SUBJECT: Status report on proposed construction at
291 Arlington Avenue, Kensington
The stop work order on construction at 291 Arlington Avenue remains
in effect. The stop work order was issued by this Department
because there were significant visual indications that the
retaining wall may be grossly overstressed.
On March 3 , 1989, Mr. Rastegar requested this Department to require
Dr. Thal to reinforce the retaining wall separating their lots.
On March 15, 1989, Dr. Thal, through his attorney, David Lonich,
requested this Department to begin abatement proceedings against
Mr. Rastegar as owner of the retaining wall.
After consulting with the County Counsel 's Office, we informed Mr.
Rastegar and Dr. Thal that it is inappropriate for this Department
to take either action at this time. The ownership issue of the
retaining wall should be resolved between Mr. Rastegar and Dr.
Thal. The structural issue should be addressed by the responsible
party.
Dr. Thal, while not assuming responsibilities for the retaining
wall, requested and obtained a proposal from his structural
engineer, Mr. H. D. Rueb. The proposal outlined how the retaining
wall may be reinforced.
