INTRODUCTION: This report is subdivided into three major sections: 1) Executive Summary, 2) Detailed Schedule and Financial Information and 3) Attachments. It describes the design and construction progress for the West County Justice Center, Marsh Creek Detention Facility and Martinez Detention Facility achieved during the period of January 1989 as well as Areas of Concern. B. GENERAL: 1. West County Justice Center a. Environmental Lawsuit Oral arguments were made to the California Court of Appeals on January 24 to the appeal filed by Marwais Steel Company. The Steel Company is appealing the court's earlier decision upholding the adequacy of the project EIR. In a related motion, the court denied the appellant's request to stop construction. b. Site Acquisition A Court mandated settlement conference is tentatively scheduled for March. A trial, if required, would likely occur in June or July. Supplemental appraisal data is currently being compiled. 2. Marsh Creek Detention Facility ♦ Wastewater Treatment Facility Temporary improvements to the existing sewer system have used up a significant portion of the wastewater treatment facility budget. As a result, the planned long range project has been postponed. No environmental study will be scheduled until project funding is budgeted. -2- CONTRA COSTA COUNTY JUSTICE PROGRAM PROGRESS REPORT NO. 6 — JANUARY 1989 C. SCHEDULE: 1. West County Justice Center a. Design: The Architect submitted a detailed equipment cost estimate on December 29. A furniture and signage budget was submitted on January 19 with a revision (listing alternatives) submitted on January 25. The Sheriff's Department, designer and Project Manager will review and refine the furniture, equipment and signage list in February. b. Construction: 1) Contract A: Substantially complete. 2) Contract B: Construction contract critical activities were underslab electrical and communications conduits, first two courses of concrete block, slabs-on-grade and concrete block walls for the Administration Building. Recommendation for and eight (8) calendar day extension has been made. 2. Marsh Creek Detention Facility a. Design ♦ Wastewater Treatment Facility On January 9, the project team reviewed the design of the interim sanitary sewer treatment system and unanimously agreed to install the temporary holding tanks and underground leach pit. ♦ Modular Dormitories The construction manager and Contra Costa Water District continue to review available water flow and pressure to determine the type of design needed to support both the new fire hydrants and fire sprinkler system. -3- CONTRA COSTA COUNTY JUSTICE PROGRAM PROGRESS REPORT NO. 6 — JANUARY 1989 b. Construction ♦ Wastewater Treatment Facility The Contractor began construction on the temporary holding tanks and continued with the installation of the gravity sewer line. Negotiations concluded with a revised completion date of April 15, 1989 due to rain delays, unforeseen existing utilities, unstable soil conditions and scope changes. ♦ Modular Dormitories The Contractor has completed approximately 90% of the underground utility installation. The interior building is approximately 809 complete. The final completion date is schedule for 2/18/89. 3. Martinez Detention Facility a. Design The Architectural Services Agreement for the Contract Documents, Bidding and Construction Phases of the project is being reviewed based on preliminary counsel review and will be awarded following final County Counsel review and acceptance. Martinez Detention Facility Professional Services Budget: $200,000 Encumbered to Date: 95,440 Expenses Reported: 29,440 E. MAJOR AREAS OF CONCERN: 1. West County Justice Center: ♦ Contract A: Oliver de Silva, Inc. a. Storm Drain in the Park: Problem: The storm drain in the park was extended, but the outlet of the pipe is lower than adjacent grades and causes ponding. Action: Right-of-Entry documents submitted by the Contractor was approved. by Southern Pacific on 1/12/89. The V-Ditch was cut on 1/13/89. The Contractor is in the process of completing the other elements of the storm drain construction. b. Street Light Photocells: Problem: Four (4) street lights installed along Giant Highway do not automatically turn-off because photocells have not been provided. Action: The work was corrected by the Contractor under protest in mid-January. C. Hydroseed Cut Slope Along Giant Highway Problem: The cut slope along Giant Highway north of the retaining wall showed signs of erosion. The contract documents do not require hydroseeding of this slope. Action: The Civil Engineer recommended hydroseeding the slope. The CM and the contractor negotiated and agreed upon a price. The work was done on January 20. -5- CONTRA COSTA COUNTY JUSTICE PROGRAM PROGRESS REPORT NO. 6 JANUARY 1989 ♦ Contract A: Oliver de Silva, Inc.(Cont'd) d. Erosion Repair Problem: Erosion-control hay bales were not installed by ODS and storm runoff deposited silt in an area adjacent to the Park's trail road. Action: The CM directed ODS to replace hay-bales and remove the silt. The repair was 80% complete on January 20. ♦ Contract B: Walsh Construction Company a. Status of Progress Schedule: Problem: Per the Contractor's 1/25/89 CPM schedule update, the Contractor is 9 calendar days behind schedule. Action: This represents a schedule improvement of five calendar days when compared to the previous report period, which showed the work was 14 calendar days behind schedule. The improvement was achieved primarily by expediting the concrete block work. In addition, a four day contract time extension is recommended for inclement weather through end of January and a one day extension for a delay by the County Code Inspector on 12/12/88. The net effect is that the project is only one day behind schedule. b. Electrical Room Equipment Clearance Claim: Problem: County code inspector stated the Contractor's layout for electrical equipment will not meet code clearance requirements. The Contractor is claiming foundation demolition cost and a six day delay stating that the room size as originally designed was too small. Action: The CM, AE and electrical subcontractor completed the reconfiguration of the electrical equipment layout to meet the code requirement. The CM performed a schedule analysis, which shows no owner-caused delay. The Contractor's formal claim submittal is due in February. -6- C 0 N T R A C 0 S T A C O U N T Y J U S T I C E P R O G R A M PROGRESS REPORT NO. 6 — JANUARY 1989 Contract B: Walsh Construction Company(Cont'd) C. Fire Riser Room Claim: Problem: The Contractor alleges that the fire riser equipment, as designed, will not fit in the allotted space without reconfiguration and claims extra costs for relocation of equipment. Action: Initially, the CM rejected the claim because the specifications require the Contractor to design and build the fire protection system. After detailed review, the AE agreed that relocation of some of the equipment is necessary. Price quotation is pending from the Contractor. d. Cell Door Lock Change: Problem: The program requires that mechanical override be provided for cell doors, however, the contract documents specify a lock but no cylinder. In November, AE proposed adding a cylinder and a cylinder extension to the lock to provide a mechanical override for each of the affected 480 cell doors. Action: CM has instructed the Contractor to price the proposed change. e. Letter of Credit: Problem: Contractor has proposed a letter of credit as a substitution for the retention from the monthly progress payment. Action: County Counsel is reviewing the proposal, pending since November 23. f. Fire Protection System Design; Problem: The Contractor's fire protection shop drawings were returned unapproved by the Fire Marshal on the basis that only a pre-action dry standpipe for sprinkler system (per contract design) was included in the shop drawings; whereas, the fire code requires a separate wet standpipe system to service hose reels in a detention facility. Action: The AE confirmed with the Fire Marshal that the contract design had been approved by the Fire Marshal prior to bid. However, the Fire Marshal still insists on the need to provide hose reels. The Fire Marshal has accepted the alternate proposal to service the hose reels by tapping into the wet portion of the pre-action standpipe and that a separate wet standpipe is not necessary. The AE is in the process of finalizing the design locations for the hose reel cabinets. The Contractor has indicated this design change will result in extra costs. -7- CONTRA COSTA COUNTY JUSTICE PROGRAM PROGRESS REPORT NO. 6 — JANUARY 1989 Contract B: Walsh Construction Company(Cont'd) g. Sales Tax Increase Problem: The Contractor requested the County consider reimbursing the Contractor for the additional sales tax which will be incurred for the unpurchased materials in the base contract material due to the recent sales tax increase from 6.57 to 77 in Contra Costa County. Action: The CM directed the Contractor's request to County Counsel for review. h. County Trees: Problem: All trees to be provided by the County for incorporation into the project were rejected by the AE and subcontractor . Action: The CM instructed the Contractor to submit a price quotation for supplying substitution trees. i. County Furnished Items: Problem: In order to assure proper coordination and installation, the CM is proposing the inclusion of several pieces of County furnished equipment (trash compactor, clothing conveyor, welding hood, and spray booth) into Walsh's contract. Action: The CM is reviewing this proposal with the County and upon County's approval will authorize the AE to prepare the technical documents. j . Floor Coverings: Problem: The ongoing interior design work is affecting carpet and tile color. Action: The AE has been put on notice to use specified materials and to make a timely selection of the colors. k. Multiplex Unit: Problem: The Contractor claims a conflict between the listed perimeter security multiplex unit and the specified requirements. Also, the specified wiring is not compatible. Action: The Contractor has been directed to more clearly define the conflicts and interface problems. Once better defined, the Architect's and Contractor's technical representatives will meet to review and resolve this conflict. -8- CONTRA COSTA COUNTY JUSTICE PROGRAN PROGRESS REPORT NO. 6 — JANUARY 1989 Contract B: Walsh Construction Company(Cont'd) 1. Ridge Line and Steel Beam Elevation Conflict: Problem: A conflict exists between the roof ridge line and the top of the roof steel beam at Buildings 1, 2, 3 and 4. The AE provided a detail which suggests the use of angle plates to maintain the ridge line. The Contractor claims this detail constitutes an extra to the contract. The AE recommends rejecting the claim on the basis that the contract requires the contractor to provide the means to maintain the roof line. Action: The CM is reviewing the contract drawings and specifications to determine if this claim is valid. 2. Marsh Creek Detention Facility ♦ Modular Dormitories a. Concrete Strength Problem: The County's materials and testing lab reported an average compressive strength of the concrete foundation at 1892 psi. The required strength is 2500 psi. Action: The CM directed the Contractor to verify concrete strength and suggested three verification options. The Contractor agreed to hire an independent testing lab to core the concrete foundation and re-test the compressive strength. Kleinfelder Testing Lab was hired for core sampling and strength test. Test results should be available the early part of February. b. Saturated Soil Conditions Problem: Due to excessive rain and poor site drainage, saturated soil conditions delayed the installation of the exterior canopies. The canopies are critical for the completion of the fire sprinkler system since the sprinkler's main is supported by the canopy. The delayed installation set up the potential for a delayed project completion date. Action: Negotiations were finalized on January 13, when the CM evaluated the Contractor's performance in site stabilization and concluded that several work items had been constructed beyond the original construction contract scope in order to minimize and control the amount of site water run off. The County has agreed to reimburse the Contractor for these extra improvements and for a portion of the cost to remove the saturated soil and install aggregate base rock within the site staging areas. -9- CONTRA COSTA COUNTY JUSTICE PROGRAM PROGRESS REPORT NO. 6 — JANUARY 1989 C. Anticipated Delayed Completion Problem: The original contract completion date is February 18, 1989. As of this report, 24 calendar days remain. Per this schedule, rain delays are affecting critical path activities thus extending the project completion date. Action: The CM will continue to monitor the Contractor's progress with the anticipation of time extensions. The Contractor has been asked to submit a revised schedule needed to assess delay. ♦ Wastewater Treatment Facility a. Fire Service Line Problem: The Contractor is nearing completion of the fire service line but the Contra Costa Water District is delaying the connection between this newly installed fire line and their water main. Action: The CM is working with both the local fire district and CCWD to resolve engineering questions so that construction can be completed as soon as possible. The County's contractor was asked not to back fill around the proposed fire line connection in order to expedite the District's follow on construction. b. Delayed Milestone Problem: The scheduled completion date of January 15, 1989 is not feasible due to the extent of rain delays and the scope of work change to construct the temporary holding tanks and leach pit. Action: Both the Contractor and the CM agreed to revise the contract completion date to April 15, 1989. GENERAL: The detailed schedule report is subdivided by three projects: 1) West County Justice Center, 2) Marsh Creek Detention Facility and 3) Martinez Detention Facility. The three projects are further divided into the design and construction phases. The design portion will include general design data and a progress narrative. The construction section will be subdivided by each contract and will provide contract data, a progress narrative, plus a bar chart. 2. West County Justice Center a. Design• The Design Development Phase approval and start of Contract Documents Phase work was originally scheduled to occur on January 17. Based on cost estimates received on December 29 and January 19, a more thorough County and Architect's review will be necessary (due to a budget overrun). A preliminary review meeting was held on January 20 with a follow-up meeting required in February. The budget adjustment process will extend the start of the next phase of work by 30 - 45 days. b. Construction: The West County Justice Center project includes two contracts: 1) The first contract was for the rough grading of the project site (Contract A), which is substantially complete. 2) The second is for the construction of the detention facility (Contract B). PROGRESS NARRATIVE a. Building One (Administration Building): Underslab electrical and communication installation was 100% complete at the west side and 95% complete at the east side. Underground plumbing installation -16- CONTRA COSTA COUNTY JUSTICE PROGRAM PROGRESS REPORT NO. 6 JANUARY 1989 Schedule Analysis Walsh Construction Company (continued) remained approximately 98% complete. Foundation footing construction was 100% complete. The first two courses of concrete block were 100% complete at the west side and 90% complete at the east side. Slab-on-grade installation was 100% complete at the west side and 85% complete at the east side. Installation of hollow metal door frames was 95% complete at the west side. According to the Contractor's January CPM schedule update, the project critical path still goes through Building No. 1. The schedule slippage previously observed for Building No. 1 (due to the Contractor's own unsatisfactory progress) in the last report period has been reduced. Building No. 1 is now only one (1) day behind schedule. CM is monitoring the schedule closely. b. Building Two (Medical/Dental/Library/Classroom Building): Foundation footing construction was complete. First two courses of masonry were 90% complete. Underslab plumbing and conduit were 100% complete. Rock/sand placement for the concrete slab was 98% complete. Installation of wire fabric for the slab was in progress. C. Building Three (Multi-purpose Building): Underslab plumbing was 90% complete. Underground electrical/communication work was in progress. d. Building Four (Inmate Housing/Central Visiting): Aside from the completion of 50% of the security hollow metal door frames at Building 4, there was no change in status at this building. The Contractor's progress effort was at other buildings. e. Building Five (Inmate Housing): The core area slab-on-grade was complete. Exterior concrete block wall first and second lifts were 96% complete, the third lift was 47% complete. Above ground electrical and communication rough-ins have started. f. Building Six (Inmate Housing): Preparation for the core area slabs-on-grade concrete pour was in progress. Above ground electrical and communication rough-ins have started. g. Building Seven (Inmate Housing): Preparation for the core area slabs-on-grade concrete pour was in progress. Above ground electrical and communication rough-ins have started. h. Building Eight (Inmate Housing): Core area slab-on-grade was 100% complete. Exterior concrete block wall first lift remained 95% complete. Above ground electrical and communication rough-ins have started. i. Site Utilities: Aside from a 5% increase in the site underground communication conduit installation (from 90% to 95% complete), there was no additional progress for the site utilities. j . Areas of Concern 1). CPM Schedule: Problem: The initial CPM schedule was rejected due to questionable activity durations and logic, crew loading and cost loading. Action: The Contractor has resubmitted the schedule, cost loading and manpower loading on 12/23/88. The CM reviewed the revised baseline schedule and planned to meet and discuss with the Contractor by the end of January. 2). Communication Multiplex Unit Problem: The Contractor stated the specified multiplex unit cannot provide the specified performance and a portion of the system is no longer made. The Architect tentatively agreed to modify a portion of the multiplex unit pending contractor's submittal of a technical proposal. Action: The CM instructed the Contractor to expedite the proposal submittal. 3). Carpet Submittal Problem: The substitute carpet submittal does not meet the specified carpet in both color and texture. Action: The Contractor resubmitted samples which matched the specified quality. However, the color was rejected by the AE. AE is selecting alternate colors. 4). Water Heater and Storage Tank Submittal Problem: The Contractor disagreed with the AE's rejection of the subject submittal and stated that they had submitted the tanks per the specified performance requirement. Action: The AE re-evaluated and accepted the Contractor's submittal. 3. Marsh Creek Detention. Facility a. Construction Currently the Marsh Creek Detention Facility program includes two contracts for the construction and installation of the modular dormitories and the construction of the wastewater treatment facility. The fire sprinklers cannot be tested until the system is completed. This delay affects the scheduling of the interior building finishes. The scheduled completion of the interior building and site work were both impacted by the delayed installation of canopies. Martinez Detention Facility a. Design The contract for the construction documents, bidding and construction phase services was approved by the Board of Supervisors on November 29. The Consulting Services Agreement was sent to County Counsel for their review on November 23. On January 6, County questioned the contract form and requested supplemental information. Revisions to the contract are being prepared and will be forwarded to County Counsel in early February. General: The detailed financial report is divided into three projects: 1) West County Justice Center, 2) Marsh Creek Detention Facility and 3) Martinez Detention Facility. Design• The Architect's basic fee is $2,705,923 of which $2,367,897 (88%) has been paid. The Architect's preliminary cost estimate for these items is $2,211,000, as of the design development phase completion. Construction: The West County Justice Center financial report includes two contracts: 1) The first contract was for the rough grading of the project site (Contract "A") which is substantially complete.
