Bragdon Contra Director of Community Development C osta DATE: April 25, 1989 Wu SUBJECT: state Legislation on Chlorofluorcarbon Issues County t SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION support the legislation below relating to chlorofluorocarbons: ` AB 1118 (Hayden) - Hazardous Waste Ozone Protection AB 2404 (Connelly) - Chlorofluorocarbon Coolant SB 231 (Roberti) - Hazardous Waste Chlorofluorocarbon SB 1138 (Marks) - Chlorofluorocarbon and Halons SB 1192 (Marks) - Air Resources: Chlorofluorocarbons BACKGROUND Five bills have been introduced into the Senate and Assembly relating to issues of atmospheric degradation. AB 1 /18 would, on or after January 1 , 1991, require the use of recycling and recovery equipment approved by the State Air Resources Board in the servicing of vehicle air conditioners having CFC coolants, and -ould require the labeling of those coolants when sold in specitied small quantities. AB 2404 would prohibit, on or atter ,;anuary 1 , 1992 , the sale or offer for sale of chlorofluorocarbon coolant suitable for use in mobile air conditioners in containers smaller than 15 lbs. SB 231 would require the State Air Resources Board to adopt criteria to determine the existence of replacement products for specified CFC applications and would prohibit the use of CFC' s in product applications for which it is determined that replacement products exist. SB 1138 would prohibit the manufacture, import or export of any product containing any chlorofluorocarbon or halon if the product or use is harmful to the environment. Solid Waste Commission County Legislative Delegation (via CDD PHIL BATCHELOR, CLERK THE BOARD OF SUPERVISORS AND COUNTY ADMINISTRATOR BY DEPUTY M382/7-83 SB 1192 would prohibit, on or after January 1, 1991, the manufacture, distribution or sale of any rigid or flexible foam product made with specified chlorofluorocarbons, or with any compound that presents any significant risk to workers or public health, or has environmental side effects. Scientific studies have shown that chlorofluorocarbons degrade the earth' s protective ozone layer when discharged into the atmosphere. This destruction of the ozone layer allows increased amounts of ultraviolet radiation to penetrate the atmosphere and pose a potential acute danger to human health. The only effective solution to the health risk is the immediate reduction and phase-out of the use of CFC' s in the manufacture of polystyrene foam products, refrigerants and solvents. During its March 7 , 1989 meeting the Board of Supervisors adopted a Statement of Support of the Environmental Protection Agency' s acknowledgment of industry' s voluntary phase-out of the use of CFC' s in the manufacture of single-serving food containers, and in support of the Montreal Protocol; therefore supporting the above legislation which would be congruent with that action. 2.
